re: Construction Baws - I have a question

I've worked Industrial Construction for 30+ years and finding good, young help has been increasingly difficult each year.
Young folks now days are soft, entitled, and have zero motivation or initiative.
On large projects, most of our better amd dependable workers are from south of the border.

Im ignorant on how this stuff works. Does this mean they are considered here legally?

If the answer above is yes, why would they be afraid in the first place?
Depends on how you define legal. A person with an asylum case pending (many other categories, Work Authorization Categories, but asylum is the most common)gets work authorization once they pass a background check. Work authorization comes with a temporary SSN, binds you to paying taxes, and shows good to work in e-Verify.
Technically those people are still in the US illegally, and have been getting picked up. They account for half or more of all current detentions from the last numbers I have seen.
Prior to this term, even in Trump 1.0, those guys weren't getting messed with assuming they didn't screw up some other way (mostly DUI), but that hasn't been the case nationally this time.
Good questions.

To oversimplify, E-Verify validates that the social security number is an actual SSN. It does not match it to the name and/or DOB. This was what DOGE was referring to when they looked at the SS benefits, medicaid, medicare... and made the statements that we have xx people over 100 years old active in the system.

Combo of some are using stolen SSNs and those that are here legally are hearing the misinformation about legal citizens getting rounded up in these raids and "sent back home". I am sure a lot are being detained, but once they prove they are legal they are getting released. How long this process takes has been greatly misrepresented by all sides (you know it doesn't take a few minutes, and I question the accuracy about it taking weeks)

Gave me a reason to charge more.

Man, these are some great posts. I've learned a lot about this process. Thanks for the responses.

Construction work is excluded from ice raids. Or at least that was the statement. I work on a site with at least 90% of the head count being Mexican or some derivative south of the border. Nothing has changed since and I haven't heard anything to the contrary. Skilled labor was in shortage waaaaay before this though.

Part of the issue with E-Verify (IIRC, it might’ve changed) is an employer can’t question documents turned in if you think they’re fake.
Used to be a booming business in Mexican border towns selling bogus credentials, SS cards, etc, probably still is.
If your guys have legit paperwork why do they hide if they think ICE is around?

I believe its still this way.

Very much depends on the area. Outside of a few in NOLA there hasn't been much in Louisiana, but I've seen/heard of them in MS, AL, and on the news accounts I follow from El Paso.

They don't care if they're illegal if it's making them money, that's how. They'll certainly go on facebook and let everyone know how good of a job ICE is doing though.

I bet good tamales are getting hard to find.
Zwolle Tamales are famous and made by rednecks.
People lined up for Mancuso's Tamales in Lake Chuck back in the day, on Enterprise Blvd.

How have ICE raids and better border control affected your line of work?
Happily, they have not seriously impacted us in an adverse manner. We had already begun taking real steps in verifying our employees and our subcontractors and cutting loose from those who did not have legitimate work credentials.
At first it drove our labor up a tad higher (not a whole lot though) and had a slight impact on the amount of work we were landing with our bids for competitive jobs. As the other guys started getting employee rosters whacked they began making changes as well, but we were just a little bit ahead of the curve and had found the sweet spot for making adjustments in labor costs without becoming prohibitively expensive.
The writing was on the wall for all to see and most of us in the construction trades voted for it [for Trump]. So, for the life of me, I can't understand why other contractors in our various trades hadn't already put together contingency plans for just this very thing.

Not construction, but the waiters at Las Palmas in Dutchtown are still here.

You should ask Jeff Landry this question as well.

Just because they have an SSN doesn't mean they're legal. Someone reported income against mine in 2001 (they reported from Missouri or somewhere, while I was living in SC.) E-Verify didn't start working to prevent the use of mismatched name/SSN combos until around 2011.
Also, anyone, including illegals, can apply for a TIN (taxpayer identification number,) which is indistinguishable from an SSN. I don't know if E-verify accepts TIN or not.

Sadly illegals are getting SSNs and the E-verify is a hot mess. It often says "you can hire this person but we don't have complete info yet" or something like that. I never got follow ups from E-verify on them.

It doesn't get accepted by e-Verify.
The way to tell them apart is all ITIN numbers start with 9, and no valid SSN starts with 9.
