They actually do a cholesterol check. As well as sleep apnea, depression,blood pressure and diabetes. Failure for any of these will result in disqualification. But that's for all DOT exams not just this one.

This has zero to do with Obama care. Actually, I would think conservatives would applaud and support a company's right to hire who they please.

My company charges different insurance rates for tobacco users. They could be testing for your rates.

I know MD Anderson Cancer Center tests for nicotine, for obvious reasons. I'm sure a lot of organizations in that space follow similar policies

I ran into this with Southern Company as well. Supposedly they can detect if you smoked or dipped in the previous 90 days. I would think this was part of the drug screen.

From what little research I could find, the test is really geared to detect daily tobacco users. Hydrate really well and there is a good chance you'll be fine.

in 21 states, employers are allowed to not hire if that person smokes, since they're not a protected class. the majority of hospitals in Ohio won't hire smokers, and they tell you ahead of time that you must not have consumed/inhaled nicotine and tobacco within 90 days of hire, and then abstain from it during employment. few reasons why:

1) lowers insurance premiums for the employers, which is the biggest reason
2) increases worker productivity - I hear people on the OT talk about how it's become somewhat acceptable that smokers are allowed to take smoke breaks, but if a non-smoker wants to take an extra break, he/she gets chastised
3) terrible smell for everyone. from working in a hospital, I can tell you that it's terrible for cigarette smoke to linger and for everyone to have to deal with it for 12 hours at a time

this is actually an interesting case in terms of freedoms and rights, and to what extent employers are able to "invade" on your personal life

BTW, a ton more places are going to adopt these policies, since it's much cheaper for the employer

The screen typically does not check for nicotine; the confirmation, on the other hand, usually does.

Detection window for nicotine in urine is 2-4 days.

Thanks. I'm not even a smoker. Just the occasional cigar. I thought I was clear after the drug screen then I learned last night that a urine sample was required during the exam too though they claim it's only for protein checks.

There wont be a confirmation done on a negative test. Screens are premlinary tests and confirmations are done on positives of the screening, unless you are on meds which should have shown up and do not....the a confirmation is done on the negative result.

Sorry, GAFF. I stand corrected. Nicotine can be detected in a screen. However, it's going to be a qualitative measure. In other words, the screen can't yield how much nicotine, just whether or not it's present in the urine specimen.

If your employer sends it off for confirmation (they won't--very expensive), that would yield levels.

But would that have all not been done at the screen? Basically if a positive came up it would have essentially failed me.

Universal Citation: LA Rev Stat § 23:966

§966. Prohibition of smoking discrimination

A. As long as an individual, during the course of employment, complies with applicable law and any adopted workplace policy regulating smoking, it shall be unlawful for an employer:

(1) To discriminate against the individual with respect to discharge, compensation, promotion, any personnel action or other condition, or privilege of employment because the individual is a smoker or nonsmoker.

(2) To require, as a condition of employment, that the individual abstain from smoking or otherwise using tobacco products outside the course of employment.

B. A smoker, as referred to herein, is limited to a person who smokes tobacco.

C. Nothing in this Section shall preclude an employer from formulating and adopting a policy regulating an employee's workplace use of a tobacco product or from taking any action consistent therewith.

D. Any employer who violates the provisions of this Section shall be fined up to two hundred fifty dollars for the first offense and up to five hundred dollars for any subsequent offense.
