In case anyone was wonder, Louisiana's 1st degree rape statute already has a putative death penalty avenue for raping a child under 13, waiting for that case to be overruled.

I found out what this means in FL. A neighbor kid was molested by a cop. She was 12. She had to be less than 11 years., 364 days. Her being 12 got him a couple years.

unconstitutional by SCOTUS in Kennedy v. Louisiana.

Yep. They may have a compelling legal argument they think will overturn it. See Roe v Wade.

What's pathetic is you getting so emotional over facts. Sorry I hurt your feelings.

I'm not emotional, I'm just calling a spade a spade. You're an alter.

I like it but Supreme Court will overrule.

Louisiana did this.

As it stands now, Alabama only executes 1.5 murderers a year. This legislation, while it might sound good, won’t be the big tidal wave of punishment y’all think it will be.

But I'm not. And even if that were the case it doesn't make anything I said any less true than it is.

These replies are always so pathetic. Sorry I don't have the requisite internet cred to post in this thread.

100 total post and you did randomly jump into a child rape thread about the death penalty and scream "unconstitutional" like you really hated the fact that it's being questioned at all

No its not. It was ruled unconstitutional in 2010 by The Supreme Court. Good luck with this law meaning anything.

I don't hate it at all. I don't rape children, or anyone for that matter, so this law doesn't really concern me. We could've had an intelligent conversation about the Supreme Court or the 8th Amendment but ole buddy launched straight into pedophilia accusations instead.

The point of this, like many other enacted laws, is to challenge existing jurisprudence.

In this case, the overturning of that ruling.

Seems the court is insinuating that the punishment must fit the crime.

I am good with that.

Now, what punishment would sit the crime of child rape.....
