Reaching here, but no one else tied these two statements together.
1) Girl that died had drug and alcohol problems.
2) Parental rights were turned over to her Aunt .. not her mom. Perhaps her mother is as screwed up as she was.
3) Screwed up mom pressing for charges as a money grab.
Screwed up situation as a whole, but have to ask why did the mother not have parental rights? Why is the Aunt not the one pushing for charges?
All speculation, but the OP story doesn't add up.
Changes nothing regarding the turd that was drunk driving.

It’s part of the case in the fact of, the girl was very negligent in life and had a terrible history of making bad decisions, as does he. Personally I don’t know her and have only known him a couple of years. I’m just stating facts.

The girls mom can’t press charges. That’s not how that works. She has no control over what he is charged with or whether he is charged at all. She can sue him in civil court for compensation, though. I doubt she would get much from the daughter who sounds like a deadbeat and technically had no kids to look after. I’m sure he will be charged with something, though. Surprised that didn’t happen immediately to be honest.

A death is a death but part of me thinks that an ATV death could result in more leniency for the driver. There were no threat to actual passengers and he just doesn’t have the same level of awareness

Honest answer, it likely won't amount to anything unless he ran someone over. A friend of mine had this happen doing maybe 15 miles and hour in the camp yard. Hit a hole and two girls died. No one's fault. Drinking or not. just sad.

ATV's seem inherently dangerous to me. Feels like a I hear about people dying flipping them all the time.

You sound like his lawyer. You’re letting him off the hook for his behavior because of hers.

Since this was a ATV did the accident happen off of public roads, was there anything done to document what his intoxication level was, as in did anyone take blood form him, did a law enforcement officer witness him being drunk, if not it could work in his favor, not that it should.

If you are drunk and cause an accident that kills someone, you should get a very lengthy jail time, and have to pay restitution to the family.

From personal experience, it’s usually 5-10 years depending on representation. Person I know was out in 2.5

Is the mom pressing charges because he owns several restaurants or because her daughter was killed as a result of "your friend" driving a side-by-side while drunk?

2 guys i went to highschool with, killed construction workers at night, while drunk.
The only jail time they did, was the night they spent after the wreck, and was bailed out the next morning.
Both got probation, i still to this day cannot believe how easy people got off for killing people while drunk. And one of the dudes, that was his 3rd DWI, other 2 while a minor.
Back in late 80's, early 90's, the easiest way to kill some one was 2 run them over/have accident while being drunk.
The only jail time they did, was the night they spent after the wreck, and was bailed out the next morning.
