What is a side by side? Like a motorcycle with a sidecar?

I’m not sure what this has to do with anything. Is this your buddy’s justification for causing her death?

Essentially it's an overgrown four wheeler with a bench seat. An over powered 4x4 golf cart with a small utility bed. They are very useful on a farm.

I don't know about in other states, but in Arkansas they are NOT street legal, and they can not be licensed for the road.

you voluntarily get into the vehicle with someone driving drunk

she was too inebriated to give consent to be driven by a drunk driver, but he being too inebriated doesn't factor in.

I hope he has some type of umbrella policy because he is about to get the shite sued out of him.

I know of two people in New Orleans that this happened to but the situation was slightly different. One ran over a pedestrian while drunk and another hit a car and the person he hit died secondarily in the hospital several days later (not directly related to the accident).
I believe both pleaded down to vehicular manslaughter and both ended up serving less than a year and a half. However there were some factors helping both defendants.

He might get sued, but if the state it happened in has comparative negligence, a jury might find that she was just as much at fault as he was for getting in the ATV with him

I knew this dude named Tobias who got drunk and killed someone while driving. He got 15 years but was hoping to get out in four. He had a hard time in prison and ended up with a Swastika on his butt

What is the relevance of adding this to the story?

The girls mom is pressing charges for manslaughter and some other stuff because she knows he owns several restaurants in the area.
Are you sure that is why? Or is it because the DA decided to press charges?

Yes. As a dad I feel the same way. It’s a sad situation.

DA will decide the charge. If vehicular homicide he does five years. If negligent homicide he gets probation.

That’s not how I feel, it’s just part of the case. He deserves jail time. My friend was not my friend before this happened. He was an idiot on all occasions. I just recently met him.

No, he’s very remorseful and even says he deserves jail time. He only blames himself. Just part of the case.

You should kill your friend so that he doesn't have to go through all the pain and expense he's about to endure.

In the context of you telling the story its incredibly irrelevent

I’m sure it’ll come up in court but it is a weird anecdote to your story and only makes it seem like you’re defending the action
