Causing a Death While Driving Drunk

I have a friend that was driving a side-by-side with 3 other people, all were drinking or drunk. He rolled the ATV and one of the girls died. They were all over 30 at the time.
The girl who died had surrendered parental rights to her aunt because of drugs and alcohol. The girls mom is pressing charges for manslaughter and some other stuff because she knows he owns several restaurants in the area. It’s ugly.
Do people usually just get probation? Should he go to jail? What usually happens in these cases?

people go to jail for at least 5 years usually

If you voluntarily get into the vehicle with someone driving drunk I have a very hard time believing you or your posterity are entitled to anything as a result of your death or injuries stemming from an accident. That's just my opinion, I have no idea what the law says.

that is called negligent homicide, a form of murder through bad actions not intended to kill but resulting in death

Last case I handled where a drunk driver killing someone resulted in him going to jail for 5 years. He served 3. I hope your friend serves longer.

He might not have to do time. I know a guy that was driving drunk, hit a telephone pole and killed his passenger. Pretty sure he didn't go to jail.

It comes down to the individual case and judge.

I recently saw a guy get only three years probation for killing someone. (5 years hard labor sentence was suspended).

Then you'll get a similar case where someone ends up doing a couple of years before getting released on good time.

Sounds like if he gets light on criminal charges, she is going to squeeze him tight for every dime in civil court.

The mom doesn't really control whether charges are filed or not. The da may take her wishes into consideration, but it is his call. He likely brings charges whether the girl's mom wants him to or not.

Pretty irrelevant.

Don't feel bad for the dead girl my buddy killed or her children, she had problems in her life and he did everyone a favor.

Knew someone who was drunk, weaved across the lane, and hit someone head on. Killed a 17 year old kid.

Got 10 years the max under Bama law.

It’s very possible that he won’t have to do time. But he will likely become much, much poorer as a result. It beats jail though.

Vehicular homicide in Louisiana. 5-30, 3 of which can't be suspended/probation.

I know (knew) a girl who was 20 in SC who drove drunk, ran over a motorcylist who had already fallen off his bike and was likely dead before she came along, per coroner. But she kept driving after running over the body. Remembers nothing.

16 years no early parole.

She's about 7 years in now.

She was super hot too. OT-9 legit.


ETA- i think the DA had offered something like 5 years in prison but her family thought they could win because the coroner said the dude was probably already dead, first offense, probably get a suspended sentence, etc. Wrong.

It's not a form of murder.

ALL murders are homicides, but not all homicides are murder.

Four drunks in a side by side , no one deserves compensation for the bad choices of any of them, but as for legal consequences the driver here will likely be charged with vehicular homicide and will face fines and prison time from 5-30 years depending on a variety of factors
