After watching it the second time, yes. This person arrives on the scene after the shooting stopped, based on the reactions of the two people that sought cover from the rear of the parked car on the side of the street.

what if the first two distinct shots were not from hayes, and from another gun?

i know, the nopd said they found casing that matched the .45 hayes had. but if a gun can get back into a console, it seems like casings could go missing, especially if NOPD is involved (i know that isnt proven yet, its just a thought)

Interesting thoughts. Innocent bystander running towards the scene while two people are seeking shelter behind a car. An unmarked police car is the first to arrive on the scene. I wonder how much of the footage they have from the camera that they haven't released.

would be incredibly dumb when there's witnesses all over with cell phones to deliberately hide casings of a certain weapon...

There's a good chance more video and witnesses surface. They may have more now that we are unaware of.

I was talking about what Hayes attorney could argue. In other words, he can use whatever decision they make and twist it into a positive. "See, they declined to look at this because they are in on it". Or "see, they decided to take over the investigation because there is a cover up." Personally, I don't think them turning down his request strengthens the insinuation that there was a cover up, but Hayes attorney can make that argument.

Maybe because he's a witness and part of the investigation...to resolve any look of impropriety.
