Insurance policies list a time with the inception date, usually 12:01am. Your friend may not be screwed but it depends on inception time and if there are any clauses that prevent crap like what your friend is trying to pull from happening.

The new insurance won't save him because the police report will list him as uninsured and any attorney worth his salt is going to see the date of the policy and the date of the accident the same and investigate.

That said, he's only out the minimum. So if his damages are $30,000 then you deduct $15,000 (the minimum) and he'll collect $15,000.

Im absolutely right. No Pay, No Play only deducts minimum insurance requirement.

Also, why the hell are MLL so low in LA?

I practiced insurance defense litigation for five years. I thought we paid out too much, too often.

15,000 deduction for BI

25,000 deduction for all property

People would be absolutely shocked at the BS we pay all of the time just to avoid litigation and protect our insureds.

Right. People like him are usually the same people that think "accidents happen" and he shouldn't be responsible for disabling someone.

Insurance companies have become adversarial, even to their own customers, on legitimate, honest claims.

They are a necessary evil and they lack basic customer service skills. The adjusters I've dealt with couldn't pour pass out of a boot with the directions on the heel.

Also, people in this thread claiming UM drivers as the reason our rates are so in Louisiana are incorrect. It is a factor, but the sue-happy populace is by far the main reason.

Definitely my experience. About 1/3 of may cases were absolutely legitimate and the plaintiff deserved the big money. About 1/3 were semi-legitimate where the plaintiff was injured by we paid too much because he/she malingered. The last 1/3 were crap where a plaintiff used a minor accident as an excuse to stop working. That's where surveillance becomes your best friend.

It's more because our courts give tremendous payouts for crap claims.
