Obviously your gf had not yet purchased the vehicle , else it wouldn't have been available for someone else to purchase. I mean that just makes good sense. It's not like the dealership sold her the car then came and took it out of her driveway and sold it to someone else.... If she had signed a purchase agreement they would not have been able to sell the vehicle to anyone else. PERIOD.

your first mistake is not actually seeing the exact car you are purchasing.
so, to your point, you didn't receive what was purchased because it was never there to be purchased in the first place.
what has the dealership offered?
did they offer a timeline as to when they can get the exact same model and from where?
if these aren't to your liking, ask for your money back.. It's really that simple. If they say no, which they wont, then tell them your attorney will contact them.

Have them pay you back in $100 bills (they have to do this if you ask but most people don't know that). Take money to casino and double it. Take half and pay off loan and buy a car with the other half. Boom, free car.

The beauty is...you have zero obligation to take anything. See what they can find...if it doesn't work for her, then she can cancel the deal and start over somewhere else. Don't be impatient and settle for anything that you feel is of lesser value than what the original deal was for.

Just the difference in APR between a credit card and a vehicle loan are enough to make me say hell naw to that idea.

I have another crazy car dealership story that I would not believe if I didn't know the people it happened too.
About 7-8 years ago a friend of mine was in the market for a new car for his wife. Well she went one day while he is at work and bought a Nissan Altima at Eddie Tourrelle's Nissan in Covington. Well after a week or so the car started pulling real bad to one side. Not sure of the details of the deal but it was supposedly a new car with just a few miles on it. Well they take the car in for the problem with the front end. Comes to find out the car had been wrecked before. So this dealer sold a used car that had been wrecked as a brand new car.

He didn't mean finance the whole thing on a cc, dummy. He meant put the down payment on a cc and pay it off rather than writing a check.

But they still aren't screwing you. Here is the deal. Let me lay down a situation in which this happens. First, it's safe to assume this is a used car, right?
Your Gf walks into dealership on east street.
I walk into dealership on West Street.
We both spend about 30 mins looking at used cars.
Your Gf tells the sales person what she really is looking for. He goes to the computer and says he has one at the west dealership that's just put online a couple days ago. She agrees to it.
At the exact same time, I am searching at the West Dealership and come across the car I am interested in. I said I want it.
So two dealerships are now selling the same car. This doesn't happen often so they are just going with it not knowing its being sold as we speak.
I pay in cash so no calls needed. Your Gf gets loan. They call and the loan company gets the Vin and it shows up as not sold.
Some time goes by and oh shite. We both sold the same car. Well, instead of transporting it to east lot customer, we go e it to west lot since he paid full in cash.
Done.
Nothing screwing anyone over. Just bad timing.

Par for the course with that dealer.
Back in the day like 15 years ago. They sold me a mustang.
Same story, had been wrecked and the transmission was screwed. Couldnt tell on the test drive. They paid for the transmission abd stuff to fix.
Ill never go near that place ever again.

El correcto. If you have the money to write a check, you have the money to make that same payment on your card. CC company will fight for you. Your bank will not.

One of the llotot (cork maybe) had the same thing happen to her. Pretty sure she sued for fraud and won.

OK I think I read all of these comments and looks like the OP stated what the problem was.
His GF went to dealer to buy a car. Dealer A didn't have that car. Dealer A located the exact car GF wanted at dealer B and made an arrangement to transfer (buy) that car from dealer B. GF signed the papers and gave deposit.
Dealer B found that they already had a deal on their car that GF wanted AFTER they agreed to sell dealer A this car and informed dealer A that the deal was off.
Dealer A and dealer B are 2 different companies and dealer B has no relationship with GF.
Who is at fault? What does they law say? Can GF sue dealer B?
Find another car. No damage done. It's called life.
