Because you don't have to to establish a DUI in Texas. You could blow a 0.0 and still get a DUI due to the way the law is written. Blowing only works against you and further establishes probable cause for the arrest. Anyone with any sense doesn't. The admin suspension for not blowing can be easily dealt with and overturned. Its no issue to get an occupational to work. For a DUI attorney, who does solid work in at least the Austin area, Florencia Rueda. I'm sure she can recommend something on Bexar county. You need somebody who knows the local for sure.

Question when did you get popped? Time is of the essence to have a real ID and such even if they took yours which they probably did.

ETA - No I don't have personal experience. Just know some folks who do this work you fricks.

Blood test aren't the same as urinalysis testing for metabolites. They'd know if the substance was active or not, and what the level was.

Spot on. Failed me on roadside, in a ditch, would not allow me to put shoes on, and did not ask for a breathalyzer. They wanted blood from the very beginning.

I had Crocs on that were too big for me, I asked to put real shoes (with a back) on and was denied.

Glad to hear some of you remember, because it effects my life on a daily basis. And if you truly hope that I beat this, thank you. I’ve never had a DUI before and I’m almost 34 and really, don’t drink.

Are you saying a blood test wouldn’t have picked up a dosage of alprazolam the next day? I beg to differ.

DUI does not mean drinking.

Driving impared for any drug can earn a DUI. Refusing the breathalyzer or a blood test will earn a DUI charge. My guess is that they thought it was a drug other than alcohol which is why they asked for a blood test. It doesn't mean you will be convicted but implied consent is real.

They arrested me before asking for a blood test. Their basis of the arrest was one officer’s subjective field sobriety test.

They (the county police) had to call a DPS Trooper in to administer the test and were shocked he failed me. They were ready to let me go and even told me to request their body cam footage to show my demeanor and lack of slurred speech or any other signs of intoxication.

Sorry to hear about this. I hope you get a good lawyer and work it out. Hijack Alert! I struggle with the same thing you do. I was shot in both my legs outside my house about ten years ago. I followed your story on here and in our local news. I didn’t die but one shot did hit my femoral art and messed my leg up pretty bad. You have me beat in gun shot wounds, I only got 3. I agree it changes your life forever.

In Alabama 7k-10k might get you out of it but I don't know about Texas. They seem to like the law out there.
