Hopefully it pays the way for Manson to get out. Guy is serving a life sentence and never harmed a person.

They will retry if forced and they have a very good case.
They have an exceptionally shitty case against Dassey. They won't retry him if they lose all appeals.
Avery is another story. The evidence is pretty strong against him.

Finally, he can get back to that math test

Just an update. The state has been granted an En Banc review by the full Appeals court (LINK ). The hearing will be in September, with a decision coming out a few months after that (could take as long as a year). This will vacate the past two judges rulings for Dassey to be released and he will stay in jail until the appeal is complete. It is very rare for these type of reviews to happen..

It's amazing that a viral documentary got a man released from a life sentence.
And mildly horrifying.

Avery's background: serial molestor and sexual abuser of family members (including Brenden), animal abuser (threw a cat into a bonfire), erratic and violent sexual behavior
Facts and assorted circumstantial evidence of the case: Woman last seen on his property, tons of calls made from his phone (with number hidden) to hers, several of Brenden's false confessions implicated Avery and cover-up of a crime scene on his property.
It appears that the police dept falsified evidence to turn a questionable, but certainly trial-worthy case into a slam dunk. Not guilty doesn't equal innocent.

quote:I don't recall these claims from the documentary. Did the prosecution introduce any of that as evidence? Will they be able to do that at a new trial? Obviously his prior conviction was thrown out, so what else was there that would be relevant and admissible?

quote:The prosecution dropped the two charges based on the confession. Whether or not Brenden's conviction ultimately is thrown out, I doubt the prosecution can or will go there. The crime scene "evidence" is much more in favor of Avery than the prosecution IMO. The simple fact that the county "recused" itself and then actively involved itself in the case is telling.

In addition, the original trial court prevented the defense from suggesting alternate theories, and excluded evidence of the victim's phone being used the morning after the state said she was killed. And Colburn's phone call checking the RAV4 plate should have been a much bigger deal.
quote:If you believe the police falsified any single piece of evidence, then you have to believe it's possible they falsified more. And that is a textbook basis for reasonable doubt. The combined malfeasance of the prosecutor's office and sheriff's office should have caused to the judge to throw out the case.

It's more amazing that any jury would convict him after seeing his interrogation by the cops.

It was a completely 1 sided documentary

Face it.. he did it. Did the police stage evidence to prove it? Probably.

Still, no one has answered my question about where that information came from.

The filmmakers left out a ton of damning evidence against Avery. Look it up. He did it.
Dassey got fricked.

Avery did it
Cops probably planted evidence and they DEFINITELY found the truck via illegal search then told the civilian search team where to go and what to do
Dassey is a pasty
the end

As someone who lived about 45 minutes from Manitowoc when this all went down, this doc is extremely one sided. Avery did it.
Dassey, well that is a little F’d up. The crappy part is that the cops didn’t need to coerce him like that. Avery was going down for this without that.
