nd get fired for violating HIPAA? Yeah I don't think so.
Would it be a violation for a nurse who works at that hospital to say, "I work there and saw this happen?"
Doesn't seem like any identifying info on the patient is being released. But I'm far from an expert.

Not a violation of HIPAA if they just say yes a young child passed away in Santa's arms. The identity of the child and the family is still protected

Kind of a straw man argument but I get your point. My comment was separate from the response to the factuality of it all.

Potentially not a HIPAA violation but likely a privacy policy violation of the children's hospital.

The news is supposed to publish facts not heartwarming stories. If you cant prove it happened, it shouldn't be news, and the paper is agreeing on this matter and pulling it all. I hope santa is telling the truth but if nobody else is coming out and saying a kid died, not specifics, but just that a kid died in this manner its not a good look for someone to publish

fake news is an epidemic. Not at all getting political because the majority of fake news is apolitical, but it is insane. You have ads all over the internet with fake news stories with equally fake pictures to get people to click into clickbait. You have real news sources picking up fake news, because in the day of twitter and social media everyone wants to break a story before verifying it because TV news is the new newspaper. When people used to say "the newspaper is yesterday's news" now the TV news is last hour's news.
So many people want to be viral, so many people want likes and people to pay attention to them that they are going out of their way to be known.
We are feeding a populace that demands constant instant gratification and being first is sometimes better than being right. If they read it and you print a retraction, they still read it.

Nurse could still be fired for speaking to the media period. You can't do that at all, not without permission from the hospital. Hospitals have certain people that usually handle the media.
In this situation....the only one that could come forward and confirm it...would be the family themselves. Otherwise it is violating privacy stuff.

Sure, but most reporters can get an unnamed source to speak on the condition of anonymity. High government officials do it all the time, and Brandi at the hospital has a lot less to lose. The fact that not a single source, named or not, can verify it tells you all you need to know.

In Texas official death records are restricted for 25 years to immediate family by request only.

Regardless it was a heartwarming story that I'm choosing to believe.
Nothing says heartwarming like a child dying prematurely of cancer right in time for the Holidays. Crazy how many of you would rather this be the outcome than the alternative, that some kid didnt die because the story is bullshite.

Might be due to HIPAA laws?
Late to the HIPAA party. Sorry!

Does it really matter? Even if it's a lie, who does it hurt? As far as I know "Santa" isn't asking for donations or anything.
Posted on 12/14/16 at 10:58 pm to lsuwontonwrap
so as long as it doesn't hurt anyone its ok to publish a lie? Let me guess, you voted for hillary?

For someone who claims to be so wealthy, your sure spend a lot of time caring about common folk things

Umm, the logic in that article is terrible:
"Neither Santa nor the hospital will publicize the names of the mourning family, so it was all a hoax."
