You and the manager should sit the kid down, show him the tape, tell him to get your bike back or else, you press charges.
(IF) he brings the bike back, press charges anyway. frick a thief.

I used to be a big cop defender because my dad was on the force for years. But a few years back I was right behind a car that plowed into a vehicle with a whole family in it at a stoplight. SUV was weaving in and out of its lane in front of me, then plowed into the other car at well over 40 mph without even tapping the brakes. They hauled arse and I followed them at 90 mph - they went to a house in a cul de sac, and I called St. Tammany police and reported it. Sat there for around 45 minutes and no one ever showed up, even after a second call. Passed by the scene of the accident and the firemen and ambulance were there, but no cops there even. Fireman told me that's business as usual for them.

Get a couple friends and a couple baseball bats and go solve the problem. It's not rocket science.

its just frustrating bc this is a pretty open/shut case.

1)kid is on video in his work shirt
2)kids mom responded to owner saying sorry her son stole bike he will return it
3)kid admits to me via text he borrowed bike and would return ASAP which he didnt
4)kid has countless arrests

They have his address and everything yet the whole process could take a month and Im highly skeptical I even get this bike back. Its just annoying the cops have a layup and bc of more important things mine is pushed aside. This is exactly why people complain about paying taxes, I paid a fortune this past year as the owner of 5 small businesses yet my kids dont go to public school, i dont have healthcare from the government, and aside from roads I really dont use any government services. The one time I need the governments assistance in a small issue they cant help.

a quick google search of his name and look at all his arrests and his mugshots

Im not an attorney or anything but why does someone like this have all these arrests yet is free to roam around, why dont people like him get real jail time. What does it take for them to get it for a year or more

Dude, stuff don't happen overnight on a simple theft case. An affidavit has to be completed, a judge has to sign it, warrant has to be placed in the system. Odds are they won't go actively look for him. It's on the computer so when his name is run, it'll pop up and if he's in the region, they'll arrest him. It'll be set on the court docket for months down the road. If he's smart, he'll take whatever plea the DA's office gives (probation). But this isn't a murder so don't expect immediate justice unless you have friends in high places

so i should just be cool with a $4500 road bike taken when we know who has it and where he lives???? Some great pawn shop is gonna pay him all of $100 for it somewhere in the coming days if they havent already. He's had tons of arrests for thefts like this, look at the links i posted off google, this isnt his first rodeo. At what point do we keep a guy like that locked up once and for all for some serious time so he learns. So its ok to just steal and get off on a little probation every time????

Not saying you should be cool with it at all. That's just the way it is. Hell, see if he will still give you the bike and keep the charges pressed against him. That way you get your property back and he has to go through the system. You getting the bike back doesn't keep him from answering for his crime. He would get probation whether he returned the bike or not.

nah I didnt want coverage bc although it was expensive it wasnt expensive to the point I needed to cover it and its on the second floor so flooding wasnt a worry either. I dont go anywhere on it except to workout. It's in a secure garage with security so theft was never even a concern of mine. Like I said this kid worked at the restaurant below the building thats why he had access to the garage, otherwise you have to go through security.

money isnt my issue, ill go buy another bike. Im just pissed off that someone stole my bike and we know who it is, yet nothing can legally be done right now. Its just annoying. I work hard, and this kid should not have my property

Time to start negotiations with the restaurant on how they will compensate you.. They hired a criminal and gave him access to steal..

If you know where he lives, just go and get the bike back.
But I'd bring some friends.

1. frick a theif. Let him get arrested so he learns his lesson. One misdemeanor arrest will not hurt. He will need to save now and get it expunged for certain jobs, but the restaurant industry hires felons, he will be fine there.

2. If you want to try and go the high ground. Tell the manager you will not press charges if he returns the bike and pays for the lock. I would expect him to lose the job and be banned from the building.

I would visit local pawn shops and see if you can find your bike. If it has been stolen and you have police report, they have to give it to you. I have experience in this unfortunately. If pawn shop has his name as a thief, they are not supposed to buy from him. Of course, this is the perfect world.

Just tell the kid:

"Man, Moms wants me to ask for my bike back...you know I wouldn't trip. It'll be like its both of ours, we'll just keep it at my house."

just curious, would I have any say if/when he's arrested later in him accepting a plea? Im reading the maximum charge for 3rd degree grand theft auto in FL is 5 years maximum and thats for property up to $5000 which this fits under, barely. Anyways Im reading that all his previous arrests could lead to him getting the max or even more as a habitual offender, but would I have any say in how far this gets pressed? Im not really familiar with any of this stuff but I would like to say right now that id like him to get the maximum possible for his 9th arrest.
