This is the second high profile poaching/trespassing case this year over here, not positive but I know in the other case they worded it that way because the guy that shot a big buck has permission to be on the land but he didn't have hunting rights.

The wildlife officials suspected his timeline was fabricated based of rumors and the photo, they investigated, and found he was also hunting on land he was not authorized to hunt on. Rather than be charged with a felony he plead no contest to hunting outside of legal hours. What is there left to be explained?

Maybe there is more to it, but evening is a broad term. Some people would consider evening the time that is late afternoon to the time it gets dark then after it is dark, that is night time. So evening can range from 4:00PM-7:00PM or at least one can make that argument.

Then what if he says "I really shot it that day, I just said evening for whatever reason" then they would have to prove he shot it the evening before.

for me, evening starts about an hour before dark. 2 hours after dark is nighttime.

I'd agree. I usually refer to my second hunt of the day as my evening hunt, considering the deer don't usually start moving until around 5:00.

None of that matters, the wildlife officials could prove he was hunting on someone's land without authorization, but they gave him the opportunity to plead to the misdemeanor charge of hunting after dark, instead of the felonys. He entered a no contest plea at which time whether he was actually hunting at night or not was a moot point.

"McCuistion told the Star-Telegram that there were several other charges that he could have pursued against Johnson but didn't, including felony charges for hunting whitetail deer without landowner consent and wasting game. Hunting whitetail deer at night is a Class A misdemeanor."

Unless the land owner is getting that $50k, this is the most bullshite story I've ever read and yall agreeing with it are some fricking boot licking pussies.

Maybe I'm reading it wrong, but it sounds like this guy hunted after some arbitrary hours on someone else's land. Am I off base with being mind fricked that a government entity has any rights to that kind of money for this?

I bet that land owner has been seeing this deer on his game cameras and wanted to shoot it himself. I’m sure he’s pissed that this idiot poacher shot his once in a lifetime deer. Throw the book at this poacher.

It's restitution to the state which is a civil matter and doesn't have to be paid. All they can do is not allow you to buy a license
