I think lying to avoid being killed is okay. It's not like the robber LET HIM GO and ain't no prosecutor dumb enough to suggest he should have run out the back door or that he was out of harms way when he was allowed to go in the house.

I'm glad the victim didn't kill the shitbag AND got all his money back. shitbag can go to prison and tell people what a frickin tard he was for the next 5-10 yrs.

I'm sure that won't stop out local esquires from attempting for a settlement.

That's a good point on the civil side, particularly if the reserve constable used his service weapon.

The only thing he did wrong was letting the guy live. He should have killed him.

Perhaps this notional plaintiff attorney can argue robber had consent to enter. Robber told victim he would come in if he didn't come out and the victim tacitly agreed to admission on those terms.

It’s a shame he didn’t kill the guy

I'm sure someone will make the case that he lured the guy in so he could kill him rather than just taking off.

Nope. In that situation, failure to retreat cannot even be considered by the trier of fact.

That's one dumb crook and one resourceful would-be victim.

More proof that shooting crooks doesn’t deprive the world of potential brain surgeons.

The only thing I dont unferstand is how the guy lived.

If he comes in and I've had 15 seconds to prepare, he's getting 4-500 new holes in him. 2 10 round mags of buckshot.

Should have killed him.

Guy knows where he lives when he gets out in 6-12 months

The best part of this imagining the constable hatching this plan while driving from atm to atm, with a small grin thinking “there’s no frickin way someone would fall for this”

Let's see. I know an armed robber is coming in my home. I would shoot and keep shooting until I was sure he was dead.
