any way out of this stupid state fine for an ins. Lapse I paid already!? NSFW

So years back I had auto insurance lapse and I didn't realize it. Found out a few months later and I paid the fine to have my license reinstated.


Fast forward to last year, the state allegedly sends me a bunch of Non certified mail which I have no recollection of receiving, demanding payment for a fine I already paid, and demanding an increasing amount for each non-certified notice I have no evidence of recieving.

Now they want 700$ for a new registration.

Is there any way I can fight this? It's bullshite.

Have you actually tried discussing this to someone at the DMV?

Why would the fine increase over time? Presumably if you didn't pay the fine you wouldn't have been given a license and wouldn't have been able to drive?

Fwiw I was forced to pay $754 back in 2015. I fought it and never got my money back. It's bullshite. So I moved away. frick them.

If this is Louisiana good luck getting anyone with the state to help you.

The hoops we had to jump through last year for taxes "owed" from 5 years prior was ridiculous. They sent my "debt" to collections even after sending them two certified letters proving I didn't owe them anything... And in the end not only did I not actually owe them any back taxes, they actually owed me $34. It was sweet justice and reminded me why I never want to move back

The state is broke and just combing through trying to find any way to get revenue from people whether it's legit or not.

frick every last one of them, especially every non helpful person that put me on hold, told me wrong information, or never answered a call or emil at all. I'm still passed at the time and $20+ I had to spend on certified mail just because the state can't even keep their own tax records straight

Seems like you can bring them the receipt for the payment you made and that should clear it up. No?

Not that it helps you, but DMV actually admitted they owed me a refund for penalties and interest on a late new car registration that was not my fault, but they said they had no way to issue a refund!

Get one of your lawyer friends to send them a letter. That usually will get someone on the phone and clear it up. Buy him a steak dinner for his trouble.

As long as you didnt pay the fine in cash, couldn't you just go back and check your bank statements from around the time you had to pay the fine to renew your license? Find the payment to DMV on your bank statement and show them you already paid it

It was years ago. I don't have the receipt as far as I have found.

I paid the fine in cash, in EBR.

Because they only took cash or money orders.

I had a similar incident. I had a van when I moved from LA to FL. 15 years later, they hit me up, wanting $700 dollars for not having insurance on the van in 2002.

I told them I did have insurance and they asked for proof. I faxed a copy of the insurance card and a printout from my insurance company.

Two weeks later I got a new letter with more threats. I re-faxed and they told me all was well.

A few months later I began getting calls from a collection agency. I explained to them and sent them the documentation also. They were pissed that the state wasted their time and it is cleared up now.

Hitting me up 15 years later is them hoping that I couldn't prove it. My wife has files for days.

If you have filed bankruptcy it's an unsecured debt and state can't collect. A friend of mine sued the state over this and won.

Dispute the fine. Ask for an administrative hearing.

A judge will call you on the phone and conduct a recorded hearing.

Argue that the vehicle in question was not operated on public roads or in a private parking lot used for commercial or retail activities as per RS 32:867 and was used primarily as a parade, exhibit or show vehicle(see LA. Rev. Statutes Title 32, Chapter 861, A.1 and 863.1, A.).

I have successfully argued this in just such a situation.
