Higher profit margin, not sales. As a poster stated above, your percentage of sales on food and liquor matters. It isn't worth the trouble getting people shite faced to make a few bucks. Your $5 beer or $7 drink isn't going to make or break us. However, it can lead to us having much higher liability insurance.

As Harry says there is a statutory immunity in Louisiana for places that sell alcohol, unless the person is underage I think.

It doesn't mean you won't have to potentially defend yourself. Then the reality of it is cheaper to payout than fight kicks in.

So if somebody were to find a lawyer that doesn't know the law and sued hooters for serving a person too much alcohol. They simply answer with an exception for no cause of action

That's all fine and dandy. In some form or fashion, it still has an effect on the cost of our liability insurance.

I hear ya, but in Louisiana dram shop laws immunize the server unless the patron is under 21.... So regardless of how drunk the server is still safe. These lawsuits have been tried numerous times and they always get bounced outta court.

Still went to court and cost money. The scum and lawyers both know you have a shot at getting a settlement. I'm not arguing that any of you are wrong, because you're not. They are still finding ways to sue and get paid by our insurance companies.

The plaintiffs attorney will ask for a $4500 settlement or threaten to take it to court. It may take the insurance company $5-$10k to defend the suit, even though they know it will not hold up in court so what's the best option?

If that is true (and I'm not saying it's not) the insurance company is dicking the restaurant more than the plaintiffs lawyer.
I could file and MSJ and get that thing thrown outta court for less than a thousand.
