It’s a complex issue. Tort laws that before 2020 or so, allowed for lawyers to keep cases with the Judge and not the jury so long as damages were under 50k. Happens to be that the wealthier Plaintiff firms were big donors to Judges. Injured plaintiffs can also sue the insurance company in a direct action claim where the jury knows exactly who is footing the bill. Juries who are typically poor and uneducated and dislike big companies. Plaintiffs’ attorneys that have doctors on standby to gin up medical treatment for slightly injured plaintiffs. Four law schools pumping out 150-200 lawyers a year in a state with very little transactional or commercial presence. A culture of “I gotta get mines”.

That is an absolutely perfect recitation of all the strong reasons why our lawmakers passed our wonderful reforms just a few short years ago, to historically lower our auto insurance premiums for the good people of Louisiana…

Premiums would likely be lowered if direct action statute was done away with. And jury limit was lowered to minimal amounts.

Last round of reform work by lawmakers, lowered the jury threshold to $5000. It’s done nothing but slow down the court system for everyone in favor of special interests. Well, that’s really not true. It’s increased the cost of seeking legal redress for every single voter and business in this state for the perceived benefit of a few special interest. It sure as hell hasn’t lowered auto insurance premiums one damn bit.

You asked for other examples of why it’s so high. The other reason is that we are a litigious state which is caused by the plaintiff attorneys, yes.
But not everyone gets sued. People file BI claims left and right, but it’s not getting sued. Relatively speaking few claims result in suits. And many of those are filed just to interrupt prescription.
But my initial answer addressed the reasons outside of what plaintiff attorneys are doing. Which is what you asked.
