Her asking for a ride can be pivotal, but just asking for a ride is not a substitute for consent.
No shite!! Never said it was.

But wasn't the grand jury only sown a "snippet" of the video? Why did the DA not present the entire video? I don't know how that stuff works.
I do not believe that the DA has to present or make potentially exculpatory evidence known to the grand jury.
Criminal lawyers feel free to correct me.

Never said you did. Calm down!!!!!

DA doesn’t have to show all evidence if grand jury doesn’t request it, only needs to show what will convince the grand jury a conviction is probable
On the flip side we had DA sit in front of us choking up because we all saw the Evidence of some terrible crime and knew 100% perp was guilty but due to a technicality with the law the DA knew a conviction for the charges warranted was impossible or improbable, then he would tell us what he could get a conviction on and we would wind up billing a lesser charge, it really sucked to know people were getting 1-3 years when we all knew they should be locked up forever

PeeJ and Chad504Boy already convicted them without hearing the case by the defense......
you're convinced of a non rape because you saw her run for 3 seconds across a street.

Both are fricked up facets of our system..

To be honest, she kind of was asking for it. She was a flirty sorority chick who wanted to party and get wild. All she had to do was simply say no to the guys who asked her to come with them and none of this would have happened.
There is asking for it (like a chick dressing sexy and getting drunk in public) and what the defense suggest...that she literally asked for it... the ride, the sex and to be let out of the car.

It’s been a decade or so I guess since I did it and my memory isn’t perfect. Yes 9 out of 12 isn’t unanimous just a 3/4 majority or whatever

Didn’t one of the accused statements say that he asked her over and over many times if she wanted to have sex and thought when her head bobbled up and then down he took that for a yes?
I’ll say it again, she was drunk as a skunk

no one is denying that, and there's physical evidence to prove that.
the question is was she too drunk to consent, and there's evidence to support both sides of that.
And i'll say it like i've said before many times in these arguments, if those boys were actual gentleman, they would have had the decency to not advantage of a drunk girl that way, even if she was telling them to do so.
Random people have sex after going out to bars every night of the week, every day of the year in this country. It's not rape every single time just b/c the girl was drunk.

Didnt see that statement. Carver in the warrant LINK said that she gave verbal consent.

Love that retards on here are defending a dude with multiple rape charges. And that a girl with that much alcohol in her system can agree to anything with a sound mind. I hope none of you have daughters.

I was responding to this post....where in warrant link does it say she responded to a request for sex by bobbing her head up and down?.... I see where Carver states she verbally consented.

There are four people being charged. We are discussing the details of the case. Some folks are playing devils advocate for the defense because its a fascinating case to discuss. The retards are those that cant have a discussion about an emotional case without getting emotional and name calling.

You keep wanting them to read it instead of answering their question, as if it is going to refute what is beign said.
quote:
Mr. Carver stated the victim asked for a ride home and he admitted that he agreed to give her the ride because he did not want to leave her while very intoxicated and the bar was closing.
quote:
Mr. Carver stated he overheard his 17-year-old juvenile friend as he asked the victim five times, if she wanted to have sex with him. Mr. Carver stated the victim gave verbal consent to his 17-year-old juvenile friend.
quote:
Mr. Carver admitted he heard Mr. Washington ask the victim numerous times if she wanted to have sex, and she consented.
and i'll continue to say that i dont' care what he says and won't believe it as 100% accurate unless theres other evidence to back up his verbal calims.
