WBRZ

quote:

The motion, which was filed Monday by Casen Carver's lawyer, alleges that an unidentified LSU student — who is not named in the filing — had sex with Brooks the day before she died. The motion said that the unnamed student caused sexual injuries to Brooks that were used in evidence to arrest and indict the four men on rape charges.

Isn't the issue here the fact she couldn't consent because of the here drunkenness and not the physical injury of the sex?

Seems like a dirty defense lawyer dragging a dead victim through the mud.

It won’t be when they trot this guy out to the stand, which presumably they are prepared to do given the motion.

"Your honor, my client could not have raped her; she had sex the day before! And Chewbacca is from the planet Kashyyk!"

I fail to see what that has anything to do with them taking her from the bar where she was so far gone she couldn't even walk on her own two legs, having sex with her while in such a compromised state, and then dumping her on the side of the road.

It's almost defamation.

This joke of a judge will probably allow it in in hopes the accused go free. No competent judge would allow it.

She loves letting rapists back to rape and murderers back to murder.. LINK

I do not know who is guilty or who is not but how in the WORLD can WBRZ and the attorney print this at this stage??? Can the judge stop this? Again, no matter how this case turns out, this is just wrong

They are trying to defame her character in an attempt to get a hung jury. There have been posters on here in the various threads basically saying she got what she deserved by partying and having premarital sex outside of this incident. That it "caught up to her". This is a classic case of "she was asking for it" defense.

The lack of DNA opens up the door to argue penetration never occurred, and this would be used by the defense to argue even the injuries can't be linked to any contact with the defendants.

It's not so much the sex, it's who she was hanging out with and having the sex with. None of this happens if she's dating 2 frat boys.

I won’t fault WBRZ for running a story on a publicly available filing. But yea, this should have been filed under seal.

So, you are saying that "she had it coming"?

If the injuries are part of the prosecution’s evidence I would think so
