Few years back I was hit and hurt my wrist and upper back. I was awarded for both, even though they weren't at critical point, yet. Both docs told me I would call them when the conditions let me know its time. I've got 2 surgeries scheduled now, from that wreck in 2015.

as long as the person in the accident is covered or it’s clear it’s the other parties fault, he shouldn’t be worried about a hospital bill.

Who’s going to cover the additional expenses if she’s seriously injured and the at fault party reaches their limits? AFLAC?

You need to call a lawyer. Go ahead and get one now so they can handle all of the claim filing for you. And you need to monitor for ongoing symptoms. Pretty common for things to take a couple of days to really set in.

In all likelihood with a case like this you’ll end up with the liability carrier dumping the policy limits and all claimants dividing it up pro rata. The UIM on the bus could be another story, but with the injuries you described to some other passengers I suspect the insurance carriers will pay up pretty quickly.

Document every complaint. Have her go see her regular doctor. A lot of soft tissue stuff takes a few days to start hurting. Take photos of any bruises or swelling. You’re about to go to war with some insurance companies

I haven’t read a Louisiana policy, but in some states you would be able to “go home” to her personal policy. If she’s a resident relative or listed on any other policies then you’d need to learn about stacking.

All of this is why you need a lawyer. Tons of claims get settled without filing a lawsuit, but a good lawyer will make sure your daughter is taken care of whether suit gets filed or not.

Exactly. That’s why she should be covered under a policy whether they pay or not.

A good lawyer will get you 2/3rds of what you are owed because another lawyer made everything impossible to do yourself.

I'm normally pretty anti-lawyer, but this one seems complicated with lots of moving parts. A lawyer is probably the best option.

I guess. Just sick of reviewing regs and having to get a lawyer to charge me after they certify their agreement of my determination. Should have went to law school instead. Less school and more money.

So if she wasn’t driving what does an auto insurance policy have to do with anything Jake? Especially if she does even have a drivers license.

Get a lawyer. My daughter was hit by an at fault 18 wheeler when she was 18. Would not drive on interstate for a couple years. Had to get professional help. You are right, not funny

Scary situation, and I hope she feels better soon. I know you said she’s in college and is 21. She’s no longer a minor, so technically she would be the actual client of any lawyer. She would have to sign the contract for the lawyer and meet with the lawyer. If you were sit in on any lawyer meetings, the attorney/client privilege would be busted as you’re a hire party in this situation. . You have no claim here and the medical bills will go directly to her. The hospital won’t even discuss the bills with you without a HIPAA release signed by her. Not something most 21yos can handle and you’d have to set up the lawyer meeting and guide her through it all, but she is an adult in the eyes of the law.
