Yes, he should. Wonder how the mother feels about all this?
Does she push for his death? Does she even get a say in the matter? Does the state absolve the parents? Likely not. Will the state ignore the parents emptional state on the matter and make thwir decision on capital punishment alone?

The kid will be out at 18 but he will almost certainly be back to prison within a short time. He will be haunted by this for the rest of his life.

One who puts a gun to the back of someones head, premeditated, and pulls the fricking trigger.
There is sonething more disturbing about this than any murder Ive come across. Kill your closest of kin outside your parents, premeditate and accept the outcome she will be dead and gone, all over a fricking game controller. I was 9 years old once and ubderstood exactly the shite I did when I was that age. I wasnt delusional.

This isn't really premeditated. It's not like the boy planned this ahead of time. They got into an argument and he went and got a gun and killed her.
And not every 9 year old develops the same. No one in here has enough information to determine the mental capacity of that boy. The experts are going to have to determine that. Most 9 year olds do know better than to do that, but it did happen in rural MS so I wouldn't be surprised if the boy was a little slower and maybe doesn't have the mental capacity to fully comprehend his actions.

Not only that, but any person who says they fully understood the consequences of their 9 year old self's actions is a liar or an idiot. Don't get me wrong....a 9 year old knows murder is wrong obviously. And he knows it's permanent. I'm not saying the kid is like "was that wrong....should I not have done that" or that he thinks he can just bring her back. But this is elementary school age we are talking about. I couldn't grasp being in high school at that time much less the seriousness of my actions, the repercussions not only for myself, but my family, and just what it meant to kill my sister.

What's disturbing is that it is a 9 year old. People kill siblings over meaningless shite all the time. They are usually just like 40 years old and terrible people. What sets this off is this kid taking the life of someone so young, but also the fact that he destroyed his own young life and doesn't understand exactly what he did.

I can accept that. I can. I hope they truly find the truth to that too.
I realize it is highly unlikely he will get the death penalty (Im not delusional to that reality). I believe that it is worthy of the death penalty if the kid understood and had the mental capacity to comprehend clearly what the ramifications of such an act was to begin with.
For one, he obviously knew that the gun could kill. If he did not he would not have gone for it. He understood shooting her in the head would do the most damage.

Why do states even HAVE to require parents to do anything? See that's EXACTLY the problem..it's lazy parenting. I grew up with unsecured weapons accessible to me.
.22LR revolver under the mattress...easy to get.
Russian SKS from Vietnam...RIGHT NEXT to the pellet rifle I WAS ALLOWED to use behind the door.
All other guns...in a rack with no locks. Ammo stored in same location.
What's different between then and now? My dad would have blistered my arse had I touched anything I didn't have permission to touch and I knew that. I was raised to respect guns and know they were not toys and had deadly repercussions. Today's parents use the "electronic babysitters" and are not involved in kids' lives.
Don't like what I'm saying and don't feel like you're this kind of parent...fair enough...now you understand how the responsible gun owners of America feel by the media stereotypes.

A capital punishment sentence for someone under 18 is unconstitutional.
