I agree with your point that bystanders were gonna be shot anyway and the article kind of hints the first cop didnt shoot because of the bystanders.(don't know why else he couldn't shoot unless he didn't have a gun) The guy was shooting randomly and the group of officers that arrived returned fire. I don't have an issue with that as they likely assumed the shooter would harm bystanders anyway so they chose to try to put him down. It seems to have worked seeing as though he ran away.
The bushes part was after the original shootout with police and the article reads like the bystanders were likely shot in the original engagement. It reads that the shooter shot from the bushes and the cops put him down. Unless bystanders were in the bushes with him I doubt the second shootout in the bushes harmed any bystanders.
Wasn't there so who knows how it all went down.
