Just wait. I spoke to a JP public defender and that’s going to be his defense

I'd find it most interesting if Higgins's public defender went to trial to fight Murder 2 and put up "self defense against imminent grievous bodily harm" as his Defense and bid for Acquittal!

That would be EXTREMELY RARE for any public defender to do because they generally don't have time to try ANY cases, especially one with such a flimsy defense.

Hey! In a previous post, I provided a good defense for Higgins's public defender: Higgins felt his face melting from what he thought was a Power Washer so he grabbed his pistol in a panicky and very hasty manner, he opened his truck door, the pistol went off accidentally, by the time Higgins could see and had regained his senses, somebody told him that somebody had died. He doesn't even remember the pistol being fired!

This bit of free legal advice for Higgins's lawyer is absolutely free!

The man had every right to shoot Lee as a 78 year old man, he felt his life was in danger.

Would a LEO be charged by a grand jury in the same scenario?

you are saying it was “premeditated “ for a few seconds and it was a planned out, cold blooded murder? Is this what you are claiming?

Let's say there are some kids outside who are throwing rocks at cars.. Some guy passes by and these mischievous kids throw some small rocks at his truck. He puts the truck in park, gets out and shoots each one of the kids. Would you consider that cold-blooded murder?

The preliminary hearing was today. Higgins was in a wheelchair and using oxygen. Some of the neighbors were there and they said they'd never seen him using a wheelchair or oxygen for as long as they've known him.

He's trying to look like some frail old man who can't hurt anyone. Pathetic.

I expected that to be his defense. Mental infirmity due to old age and some form of dementia

His lawyer obviously watched Goodfellas.
