Innocent as determined by who? You and Colin Kaepernick or a court of law and a jury of one's peers? Pretty important distinction that can very quickly answer this question.

If they said "all rise" in court when a judge entered, yet a man continued sitting....wouldnt that be deemed disrespectful??

If a soldier failed to come to attention when an officer entered, how would that be viewed??

If someone stuck out their hand to shake it, and you didnt offer yours back, isnt that disrespectful?

Anything done purposely contrary to standards long set within society can certainly be viewed as disrespectful

Most people judged the merits of the circumstances. But of course, if the circumstances and conclusions drawn don't match yours, they must be illegitimate.
