Should be obvious the NFL has been and is dragging their feet on the appeals. Can't imagine she doesn't see this. Appears to be a pretty textbook case where a TRO should be issued. She could do that now and defer any ruling on the merits of the actual injunction until after the NFL decides to perfect the appeals.

I guess she's sort of stuck. Obviously she wants to rule as quickly as possible to get the players back on the field, but an appeal could come down pretty shortly after and wipe that out. So she's trying to wait until they're done but realizes the damage it's doing in the process.

At this point, inertia by the NFL and reluctance to rule by her is doing damage to the players, which is why this is the perfect situation for a prelim injunction/TRO. Let the NFL drag their feet from that point forward or rule on the appeal, then she can address the merits of the full blown injunction. Should she issue a TRO today, watch how fast the NFL has that appeal they promised by August 30.

Why is this something the NFL is dragging out? I've no doubt they are doing what they can to delay it, but this is an appeal of a federal arbitrator isn't it? I would think the NFL wouldn't control the schedule.

My understanding is that it is just an arbitrator that the NFL selected and pays for (no bias there)...just like in your credit card fine print that says you will have to arbitrate any disputes before an arbitrator of their choosing at a location of their choosing. It's not a "federal arbitrator" in the same sense that Judge Berrigan is a federal judge.
The whole point is that injunctive relief is all about preventing irreparable harm, which is what is happening to these players by having this arbitrator's ruling dragged out like this.

When it comes down to it, the judge is worried as soon as she makes a ruling, it will get overturned by the appeal hearing. She wants to be the one overturning them.
