Kim's idea to Jimmy (on the phone when the episode ends and leaves you hanging) is to stall the trial until Jimmy gets his licence back... remember the montage in this episode to show how many months went by? He's only a month or two from getting his license back. Then Jimmy can be this guy's atty and Kim can stay clean.
But they are on the splits. Kim and Jimmy both know it. Right now, they have both decided this, it is already over in both of their heads. Remember, again, the montage in this episode showing time passing. Because they actually do both love each other, neither is willing to officially break it off at this point.
