Is there honestly anyone who can say that they wouldn't have unloaded their entire gun into John Doe after finding out that he not only killed your wife (by decapitation, mind you) but also your unborn child that you didn't even know about? Even the strictest of non Death Penalty advocates would have to have the utmost inner control not to want to obliterate this guy.

It's a movie not real life. Of course every man would have unloaded and many would reload and unload again.

The M'Naghten rule would not allow a temporary insanity defense. He likely pled to a low manslaughter charge due to severe emotional distress. He could claim reduced capacity due to sleep deprivation and work stress (pressure from superiors to end the murder spree). The only way he would not do jail time would be through jury nullification.

None of that is relevant unless he was actually charged. No way a D.A. is charging him in that situation.
