There's got to be some more context to this sequence of events to make it legal.

If I went to a bar and picked up a chick, brought her back to a hotel room and had someone secretly filming inside, wouldn't I be thrown in jail? Let alone if I did that, didn't tell her, and then released it publicly for money. Am I missing something?

He certainly crosses some ethical lines. Some of the scenes in the first one made me pretty uncomfortable with how he took advantage of people's niceness and generosity. The lady that taught the manners class comes to mind.

But legally, from what I understand he gets signed waivers from everyone that makes it into the film. I'm guessing Rudy signed a waiver thinking it was legitimate news interview, which from what I read was how they framed it - she was interviewing him. When the interview was done, she invited him to the bedroom of the suite where this scene played out. I don't know how it passes legal muster when it is hidden cameras though.

They have to get a release from everyone to obviously use their image, likeness and persona in the movie.

Most States require that you have to tell the person they're being recorded if they're not in a public place.

But yeah, even in the lawsuit from those racist frat boys in Borat...they admitted they were told it was being filmed, Borat - was making a movie (they didn't tell them it was Sascha Baron Cohen) and the kids signed releases to be on camera (they claimed they were duped.)

So to answer your question, especially after the first movie's lawsuit...nobody is being secretly filmed, no one who appears in the movie is doing it against their will and they all signed releases and were most likely paid and had contracts with Cohen's production company. So yeah...staged if you will.

Im going out on a limb here, but something tells me he doesn't make fun of any democratic political types. I mean, the content at some of those antifa protests alone would be great comedy. A bernie rally? Same.

Giuliani has turned into a political hack, but I'm not a fan of Cohen's gotcha movies either. Editing down Giuliani to make him look at his worst is the comedic version of shooting fish in a barrel.

the timing of the Rudy thing says it all. The borat guy is smart. he knew at least a third of the country and 90% of all media would salivate over it. Timing is everything.

I don't know what went down with that, I just read about it...but Rudy must've agreed to something...I mean he's the POTUS attorney...I mean he took on the Mafia.

If he signed some bullshite release and got duped by Borat than Cohen is not only playing with legal fire but a genius.

Also maybe Cohen doesn't care about getting sued after the fact...with the money and sensationalism that bits like this bring to the movie, maybe they factor in defamation suits into their budget.

I think a big part of the problem is that it's almost always one side that is the butt of the jokes, so it gets pretty annoying.
