My guess is that with so many teams now expanding netting, a personal injury attorney saw an opportunity to claim negligence, that MLB and the Cubs are by default admitting their protections back then fell short.

Foul balls getting hit into the stands are part of the game and a risk one assumes when attending a baseball game, if you get struck and injured by one, I’m sorry for you but you’re not entitled to anything legally

Fair enough but that doesn’t nullify my point foul balls going into the stands are an inherent risk of attending a baseball game. Let’s also factor in the negatives of expanding netting: part of the attending baseball game experience is the ability to observe two teams play unobstructed by any visible hindrance, like nets, possibly engage with the participants and get an autograph, and the opportunity to catch a foul ball, a baseball tradition for spectators. People sitting courtside at basketball games assume the risk a player may inadvertently strike them going after a loose ball or whatever and I’m sure erecting barriers would be reasonable too to eliminate that risk HOWEVER, like baseball, it detracts greatly from the entire point of attending these games. Your point is noted and fair but I don’t buy it and any judge with common sense shouldn’t hold the Cubs and MLB liable here.

Bartman should sue too. The net would have made the ball completely uncatchable for Alou, and he never would have been blamed.

so should the netting be extended around the whole field? should there be nets in the outfield? you can get hit in the face out there as well. or people just could assume some responsibility while being at a baseball game and be sure not to get hit in the face with a ball. not everything has to be someone else's fault. she can assume some responsibility for what happened.

After reading about her location and researching Wrigley’s seating chart, I’m even more convinced they shouldn’t be liable under the Baseball Rule, just no plus it’ll detract significantly from the game for spectators, that’s why the Baseball Rule exists.

They should probably install nets all over Augusta National too. Wouldn’t want someone to get hit by a golf ball. All of those people deserve money too...

I never take my eyes off the batter. If anyone around me talks to me I ignore them. Try calling or texting me? No sir. Food? Water? Beer? I consume those in the bathroom.

These are simple rules to go by and if this woman had followed them she would be in perfect health.
