A woman has taken legal action against MLB and the Chicago Cubs after being struck by a foul ball at Wrigley Field in August 2008, reports WGN 9. Laiah Zuniga, 28, was hit in the face by a foul ball while sitting six rows off the field in club box seats for a game against the New York Mets. Zuniga suffered permanent damage.

quote:

Zuniga suffered permanent injuries to her eyesight, smell, taste, teeth as well as frequent bloody noses, according to the complaint. She also reportedly suffered a spider fracture under both eyes that extends down her face.

quote:

"Major League Baseball and the Cubs were aware that severe injuries from foul balls could happen to its fans sitting in rows near the field because it had happened many times before," said Zuniga's attorney. "Just late last year the MLB announced that all 30 teams would extend netting from foul pole to foul pole this year, but it's too late for Laiah."

Sucks for her that she got permanent injuries but I think being aware of foul balls is part of going to baseball game.

Yep totally the 16 year old girl is a dumb bitch for not catching a 90-100mph screamer with presumably no glove. Get a life.

How far down the line was she?

I agree with the extended netting all the way to first and third base, but I don’t like the netting going all the way down the lines to the outfield wall.

It's unfortunate this happened to her but it's ridiculous she's allowed to sue.

Personal responsibility. Everyone knows what baseball entails and you are responsible for protecting yourself to a degree. Almost any activity you do in life has risks that you tacitly take responsibility for when you undertake them.

There’s a reason every stadium has extended nets down the baselines.

She’s got a legitimate beef imo

1. Feel terrible that it happened to her
2. You have to expect a live ball to be hit your way at any time
3. Why am I seeing this 12 years after it happened?

I agree totally, if I was the Cubs or MLB, I’d gratuitously pay her for her injuries for good will and would just be good business but hell no a court shouldn’t rule in her favor, that’s the whole point of assumption of the risk in these circumstances

At least she was only hit once:

quote:

The strangest incident occurred on August 17th, 1957 in Philadelphia during a game against the New York Giants.

Hall of Famer Richie Ashburn hit a foul ball that struck “Alice Roth squarely in the face, breaking her nose,” writes Daven Hiskey. “The game was then paused as medics came in to tend to Roth. As they were carrying her away on a stretcher, play was resumed and Ashburn fouled off the first pitch thrown to him.[emphasis mine.] This foul subsequently struck Roth as she was being carried off by the medics.”

The second foul ball broke a bone in her knee. “The fan, Alice Roth, was the wife of the sports editor for The Philadelphia Bulletin who was there with her two grandsons,” Bill Chuck notes. “There was blood everywhere.”

Fortunately, this story has a happy ending. “The Phils treated the family royally after the event and the kids were invited into the clubhouse and given free tickets and an autographed baseball,” Chuck adds. “After that, the kids visited Roth in the hospital and one reportedly asked, ‘Grandma, do you think you could go to an Eagles game and get hit in the face with a football?””
