I agree with most of what you're saying. However, I disagree with your last point. While I'm sure Stewart is a fricking moron, even a fricking moron knows that driving a car at someone would cause death at that speed.
Considering he had a full lap to calm himself down, I don't see how this isn't blatant 2nd degree murder. Now he will never get charged with that, and I understand that prosecutors have to be conservative if they want to win), but it was definitely intentional.

We don't live in 18th Century Europe, guys.
While I have my doubts about how much time Stewart will serve (if at all), there will be civil suits for years. And there will likely be a serious criminal proceeding as well.
