if I jump out of the stands and walk out on the track in a race I'm putting my life in danger and I'm gonna be held responsible for whatever occurs. Drivers aren't expected to dodge people on the track. That being said he sure shouldn't of hit that throttle

If you're trying to give the kid a message to back off, wave him off. Don't throttle on a caution, and fish tail into him when you're too close to make up for an error. He's fricked
