I'm not even gonna pretend to know how this will play out in the eyes of the court. You could argue that all day.
Common sense tells me this was a senseless tragedy that could have been avoided easily. My opinion is that Stewart is more at fault here and should have to face the consequences for acting like a jackass unless the kids parents come out and say they truly believe it was an accident.

His car moved after he hit the guy. Doesn't look like he swerved before and i cant tell if he accelerated or not.
I think if its proven that stewart accelerated right before he hit the guy then TS is screwed

Right before TS hit him, ward plants his right foot, puts his hands out and tries to push away to his left to avoid Stewarts car and the car just took him out. It actually looked the front right tire hit ward first, pulled him under the right side of the car and the back right tire kicked him out.
