Goddamn you are obtuse.
He would have hit him if he were directly in front of his car, like he was in front of Stewart's. You're creating a fantasy based on your hopeful outcome.

quote:Stop. You don't fricking know this... cars were passing on the low and high end. We can actually see Ward go down the track... but we cannot see Tony go up or change direction prior to contact.
They just saw him.
quote:See above.
By the time he walks into the middle everybody has seen he has lost his mind.
quote:And Tony wouldn't have either if he had kept his arse at the top of the track.
because the guy who drove high STILL didn't hit him.
quote:You cannot state this as fact.
It isn't some freak accident.
quote:Oh look! You're not stating something as fact. I'm shocked.
Tony probably

quote:How are you so sure that tony saw him? Did you watch the longer video that shows where the accident occurred? It's right after a turn. His view could've easily been obscured by the guy in front of him.
I already addressed this. He just walked out front. They just saw him.

Assuming that Tony accelerated right before impact to sling dirt on this dude, I think he would catch a percentage of fault,
Proving my point, another assumption.

How much is this going to cost him in a civil suit?

Stewart didn't see the guy until too late.
That would probably be what I would say too.

10 million?

It's probably exactly what happened based on the video.

Maybe at 100% liability, but you have to put a hefty percentage of comparative on the dude that got out of his car and was walking around on a dirt track trying to shoot the bird to a dude in a dirt track car.
TS will most likely pay a decent sum just for the PR like Donte Stallworth did.

One second y'all say you can't tell anything from the video and the next you can make the assumption he likely didn't see him based on the video
How does that make sense?

the first car that passes before tony slowed down rapidly....alerting Tony that something was not right.
I think Tony was a bit aggressive in his attempt to avoid the person(not his fault entirely...they dont train with manakins decorating the track for the purpose of evasive manuvering.)
I think Tony should have reacted sooner but even at a slower speed there would still be no guarantees that he would have avoided him or still not killed him by making contact.
I dont want to sound heartless but the guy was walking around on a dirt track at night time in the middle of a race...
While Tony is no humanitarian by any means...a murderer is a bit of a stretch.

Both arguments are assuming a lot on a video's LOS that is perpendicular to the track

You think Tony Stewart didn't see him?
I gotta throw the bullshite flag on that.. Sorry man

I just hope there is an audio of TS & the Pitt crew.

Tony wasn't dipping vagisil extra. I would suspect he tried to scare him or went into full homicidal rage.
Either way, natural selection is a glorious thing to behold
Tonys not responsible, the dead guy is

I'd be more willing to accept the "he just didn't see him" defense and call it case closed if we weren't talking about one of the best drivers in the world cruising around at highly reduced speeds.

why are his wheels going to the right, right after he hits him.. you think natural to jerk left if anything as everything was to the right of him.
you can see the car to the right crashed against the wall (you are the one that bumped him) you know when you are getting back to that area to be more alert. the area is limited to the right. i understand anything can happen after you hit something. just seems like with a crashed car on the road there should be some sort of more caution going on and if anything you would pull more left than any right.
with that said tony will be fine as the guy should have not been walking on the course like that. it sucks for everybody.
