USFL sued by original league; alleges trademark infringement

The complaint filed in California on Monday alleges trademark infringement, false advertising and false association by the new league. The group is seeking an injunction to prevent the new league from using any names or logos associated with the defunct league.

The original USFL played games from 1983 to 1985, and the group suing the new league alleges Fox Sports and its partners didn't properly obtain use of the league's trademarks and other intellectual property. The suit calls the new league "an unabashed counterfeit."

It should be included as one of the main points that because of the nature of the rosters they will tarnish the competitive history of the original USFL. Have you seen them rosters? A friend of mine told me he gives the league 3 years. When I saw the rosters I said I give it 3 weeks. They not just scrapping the bottom of the barrel they are scrapping the ground under the barrel.

If the original USFL put half the focus on football that they put in litigation, they would be on par with the NFL by now.

Who could be surprised by this?

On the surface, this looks like a tough case for the USFL UNLESS they kept renewing the trademark on the league and the team for the last 35 years or so. Because they certainly were not using that trademark at all.

That's what I was thinking. I seem to recall that car manufacturers have to re-use a name after about twenty-five years or so or they lose the rights to it. (i.e. Bronco, Impala, Charger, etc.)

The XFL partnering with the nfl basically killed the USFL before it even starts up. I really don’t see how this league can prosper.

If I recall correctly, the current USFL is a new start league and doesn't claim the history of the 80s version. They were able to use the logos because the old school USFL did not renew or use their trademark/IP/etc... in many years. I bet this will be quickly dismissed.

Does anyone really want spring football? I always welcome the break after keeping up with the NFL/NCAA for half a year.

The problem with these leagues is the lack of viable starting QBs. The NFL has enough trouble finding 32 quality starters. These leagues need to focus on college style offenses with running QBs. This allows for quality football while getting by with second tier players.

I am old enough to remember the Original USFL. Outside of a couple of teams the play was surprisingly good.

The new folks could have avoided this by choosing an original name and team names, but the original USFL folks should have filed at the outset and not the last minute.
