stallone is on record on video saying chuck wepner was the inspiration for the film. there are also many other parallels to the character besides the ALi fight.
The man was do a fair bit of compensation.
Stallone is a big POS for many different reasons, this story being the least of them.

I don't know that he ever used Wepner's name or likeness to promote the film. If anything, that film did more to promote Wepner. I could see if he had used his name or likeness anywhere, but I've never seen a single poster for Rocky where Wepner is mentioned anywhere.
Not on posters, but in interviews and promotional videos like the one mentioned on the Rocky DVD.

Did he mention that watching the Wepner fight helped inspire him or did he sell the movie as "Come see the film adaptation of the life and times of Chuck Wepner!"? It's two totally different things in the eyes of the law.

It doesn't really matter that Stallone was inspired by Wepner's story. It's that Stallone made those statements..."he was inspired by Wepner's life to write the Rocky character" and the claim by Wepner is that they were for promotional purposes. The crux in the allegation is that Stallone was using Wepner's name in interviews and on marketing materials for financial gain; to increase sales of the movie.
Wepner alleged 3 counts (the other two were dismissed):
1) Violation of his right of publicity - Stallone used his name to promote the movie and for commercial purposes without consent or compensation.
- Stallone said he had a first amendment right to make truthful statements about the origin of the Rocky character.
- Court said Stallone did not have to make those statements and sided with Wepner that he had sufficiently pled his complaint and the case could proceed.
(The actual merits of the allegation are a different story.)
I would be surprised if Wepner received a large settlement (his pleading $15 million means nothing.) How much did the use of Wepner's name increase profits for Rocky? Who knows?
Glad he's getting something though if Stallone promised him certain things (one of the allegations that was dismissed.)

didnt watch it, but heard the guys on 104.7 the score talking about it.
They said stalone was really made out to be the bad guy. Was this true? I know he stole the guys story, but didnt he eventually give this guy a shite ton of money?

He didn't steal anything...
Wepner getting a shot to fight Ali inspired Stallone to write a script about a fictional character who is considered a bum but gets a shot at the title.
It's not Wepner's biography. Rocky is a work of fiction. Every work of fiction is inspired by some damn thing.
He allegedly was using Wepner's name to garner promotion/sales because it sounded cool if the real world met the movie world. That was Stallone's alleged tort.

Just because Wepner's fallen on hard times and we feel bad for him doesn't mean he's entitled to compensation from Stallone.
You obviously didn't watch it...Hannity!!!

God a blind man could see he ripped off Chuck. I don;t if any of you know this but just like the movie said he is a local hero. Still drives a car with the Champ as a license Plate. Saw him last month in mcDionalds and talked a little. Only person tougher than him was his daughter. She used to come into Baskin Robbins and yell tat all of us. She is now a teacher and a cheeerleading coach. My son knows his grandaughter.
The big thing is that here was a blue collar guy who had his shot at the title. Rocky through and threough. When the movie came out, there were lines around the block becasue it was about him.
Running up the stairs in Hudscon Ciunty Park like Rocky Been there done that

WTF was Wepner babbling about regarding Cop Land?
Posted on 10/26/11 at 8:36 am to Zamoro10
my guess is the settlement wasn't that big. I would be shocked if it was more than a million.

It was probably a quarter mil at the most. The dude was a liquor salesmen before the settlement and after it.
I'd love to know how many hookers he ran through with the settlement money though.

I didn't watch the documentary, but didn't they fight in 1975? Rocky came out the next year....that would've been a quick copy if Sly wrote, filmed, directed, and produced Rocky after watching Hepner's fight just the year before.
He wrote it himself, directed it himself and they filmed the entire Rocky in less than 30 days! I saw a special about how many things, scenes etc that they had to change because of budget restictions. I never realized it when I first saw the movie but at the fight there are about 20 people there filmed at different angles.
BTW, I was an anti-Ali guy and remember watching the fight.

I did watch it. I'm somewhat familiar with the law on that topic. And I've read several stories on the Wepner/Rocky/Stallone beef from before this one-sided piece.
I can sit here and point out the every detail about all the elements that Stallone & crew had to do themselves to make an Academy Award winning movie that didn't involve watching a fight between Wepner and Ali. I'm not going to. I'm not going to type out a whole detailed legal argument for you without being paid to.
My opinions in this thread are conclusions based on the info I've consumed. Take it FWIW.
Just understand this: As a litigation strategy, there are many times when you believe you are going to win a case on the defense side, that it still is more economical to settle. Even winning trials costs money. And there are always variables, including the record of the particular judge you may draw that dictate your level of risk.
For the issues themselves, Zamoro did a pretty good job laying those out in his post above.
