Seems to me that's pretty cut and dry as to why he would EASILY WIN a lawsuit.

Owners have to go thru arbitration.

Not that I'm aware of. He's a terrible person, but I think the backend of this is going to be messy.

As posted upthread-

quote:

The NBA's constitution, which is confidential, reportedly contains language permitting owners to authorize the league to sell a team without an owner's consent. The language, SI.com is told, only covers very limited circumstances and these circumstances concern team finances -- namely, when an owner can't pay his bills.

Without the circumstances regarding that language being spelled out, I don't see how Sterling loses. It sounds like the circumstances outside of financial difficulty are so limited that it would be extremely hard to invoke them.

What I'm saying is that there are bylaws that have been bargained by all NBA owners which are confidential. I'm sure Silver knows and all the otehr NBA owners knows the process and they will stand shoulder to shoulder to protect the NBA brand.

If a CEO of any company comes out and say anything racist, the company's board will vote to kick his arse out.

I'm sure the NBA has some moral clauses for owners inside of their contracts that if they do something to compromise the NBA brand, the ownsers can take a vote to remove his ownership interests.

He's also been awarded numerous times by the NAACP, (that part is all of a sudden forgotten)

I'm black and I say frick them. That was all about a dollar in which I think Sterling made a hefty donation to them for those awards for his image. They can kiss my arse because they are all about their organization just like Jesse Jackson is all about himself and really DGAF about the inner city black people like they pretend to be.

Using that logic, who cares? it's a private conversation, he can say whatever he wants.

why do people care what a private individual says?

It doesn't really matter what random people think

It only matters what his company thinks (the NBA)

Honestly, I'll tell you all exactly why Silver pulled this card. If Sterling only gets caught being racist to blacks, he wouldn't have been so harshly treated. The second he talked about Jewish racism in Israel, Silver must protect the image of the motherland and call out the guy. It's pretty despicable and cowardly of Silver if you ask me. The double standards with regards to racism are just ridiculous.

this is definitely having a financial impact on league profits, branding and so forth insert super impressive verbiage here.

Congrats! That is irrelevant. "financial reasons" meaning a "Repo Law". If an owner fails to pay the bills, etc. Not because his racist opinions and the then ensuing media driven shite-storm put a black eye on the league. If the media would refuse to cover this story, you know what would happen? People would care about the actual playoffs going on (I know, there are still a few out there, me not being one of them). But this story was/is too juicy to let go and the fires were stoked. Now it will be drawn out in court for years and the NBA will lose this case in the long run, as they should.

I'm a employment law attorney who practices before the EEOC. Based on the private comments alone, I think the chances of a successful hostile work environment claim, which are extremely difficult to win without tangible employment actions, are nil.

Now, as I said previously, the prior course of conduct may matter, but as I don't think the NBA used it in reaching its decision, I don't think it is applicable.

In the end, the argument would be that private comments to a SO made outside of the work environment created a hostile work environment. That just isn't a winner.

I'd be happy to debate this further with you as it's an interesting discussion. Don't want to derail the thread. I will end with respectfully disagreeing based on my own 20 years working in employment law.

A board member of a company who says something stupid may not necessarily have a multi-million, if not billion-plus, investment in the company in question.

Bill Gates could start spouting 9/11 Trutherism tomorrow and still remain on the Microsoft board if he owns enough stock to win any challenge against him.

It almost sounds like he was telling her not to embarrass him PUBLICLY. He didn't care what she did privately, just don't post it on instagram or bring it to the arena.
