Has the picture of the girl he was with in the club been confirmed or debunked as being on the night in question and of the accuser?

It would have to be pretty obvious that it was false allegation. And he has more to lose by keeping it in the public eye than she does as he is more of a public figure. It would probably be resolved about the time of next years bowls.

I think it's far more likely that that quote isn't being interpreted charitably in the OP. The lawyer admitted the sexual activity occurred and was consensual. It's not difficult to imagine a reporter "pressing" him who asked if the alleged victim had consented in a way that would get "I'm not saying that" as a reply. (ex. "So you think the alleged victim is lying when she says that she didn't give consent?" to which "I'm not saying that" would be a perfectly valid response)
Seems more valid an explanation than a faked toxicology report to me
