Dale Jr.’s trademark claim is for a specific stylized 8, which had already been trademark in the past by Teresa Earnhardt/Dale Earnhardt, Inc. I don’t think there is any way that the Dale Jr. 8 and products related to it would be confused by the public with Lamar’s Jackson’s “8 Era” brand and products related to his brand.

It shouldn't be. Dale Jr has been using that 9 since 1999. Lamar Jackson was born in 1997. So Dale Jr has literally been using that 8 since before Lamar Jackson could count to 8.
