Home Sale Question

My home is under contract. During the inspection period there was some wear and tear observed on the roof. It was described as potential hail damage.
As part of the sale, we agreed to replace the roof, based on the hail damage. Note that hail damage was written in the DDI response. After numerous inspections, and an adjuster visit, it was determined that the damage is not weather related, but a potential manufacturer defect. The damage has also been described as superficial and cosmetic, not structural.
Ergo, it is not covered under our policy.
We have all parties coming to the house for a 5th inspection this week. I have proposed the following:
We have already initiated a claim against the manufacturer... and the roof has a transferrable warranty. This will go to the buyers.
I have set aside 5k in escrow. If the manufacturer denies the claim, the buyer gets the money. If the manufacturer replaces or repairs the roof, I keep the money.
Is this unreasonable?
UPDATE: It all worked out. No storm damage.

Seems like a lot of work in this sellers market. Tell them they can take the house and deal with it since the warranty is transferable or your putting the house back on the market

I can do that. We had 4 offers after 1 day on the market, all above asking. And it appraised for over asking.
Honestly, I don't wanna go another round with a sale. Mostly because I don't want another buyer to get us in this exact spot.
That and I have a 12 month pregnant wife and we are trying to get into our new home ASAP.

In this market you shouldn't be doing/dealing with any of this. Put it back on the market you won't have an issue finding a buyer who will not try and nickel and dime you.

Honestly if it were me and my insurance adjuster said it is not weather related and therefore not covered I would not agree to give anything for the roof. And being the roof is less than 10 years old a little wear should not be concerning. Hell I just sold my house for 10K over appraisal with a 20 year old rood with some wear. And yes I had my insurance company come out and verify the roof was still good.
Hold out and get the best deal you can! I had a couple try and low-ball me and they also wanted me to give them 4K for a new compressor unit because their HVAC guys "suspected" a coil leak on the unit. I had my HVAC guy come out and check....yes there was a leak however it was a simple fix on the dryer outside of the unit ($400 fix) I told my realtor to tell them no deal, they pulled out and less than a week later I had an offer for $15K more.
P.S. and if you wife is 12 months pregnant as others have said....get to the ER! LMAO

My house is under contract. Home inspector (who didn’t climb on roof) took a picture and said roof was missing shingles. Buyer is going VA loan and before appraiser comes out we had to address. We hired a roofer to make inspection. They noted it was top portion of architectural shingle that came off (from Ida) but shingle was sound. Damage was only aesthetic in nature.
Roofer gave me a written response that it was not a structural issue. Buyer and Lender OKed. Had to pay to get written response but issue is now behind me.
You may have to address in order for the lending company to sign off on loan.

This is already done. The original inspection came back as 'potential'. It wasn't labeled as defective so the bank doesn't give a damn.
Hell the buyer even paid for an air quality test to make sure there was no mold from leaks.

Not necessarily. We agreed to fix it on the basis of hail damage. There is no hail damage.
Realtor is somewhere between telling them to get fricked and paying some of their closing costs to make the problem go away.

Are they offering you asking price? If the answer is yes or more then I would seriously consider putting some of your profits towards closing to sweeten it up. However if your not making much or if they got you to come down my answer would be "get bent, next!!"

I’d tell them to fricking pound sand and take the next offer. They will still buy your house I promise you
