You say LSU terminated him, but it was Woodward. Board approval was not provided which invalidates Woodward's action, i.e. LSU's arguement.

Terms of the Separation Agreement, totally different contract. You do not need a Separation Agreement until the employee is fired.

Well, the contract has terms for what happens after separation. No need for a new separation agreement unless both parties want one.
BK's email on 10/26 made it sound like there was at least some discussion of a negotiated separation agreement. Most likely, as a poster stated above, this would be a mutually agreed-upon accelerated timeline and amount for payments and a modification / elimination of the mitigation clauses.
