errrrr....assault does not occur when you curb stomp someone. That would be battery

A lot more serious than assault.

Again...Link?

Kick in the heat of streetfight = curb stomping?

Plus, the video does show the guy on the ground was NOT incapacitated. Facts are a bitch, I know.

I wouldn't go that far.

Temp restraining orders are granted very, very quickly (same afternoon, in this case) with no attempt made to determine facts or give the other side much of a chance to respond.

It's not a judgment of anything other than dude needs to stay the frick away from his ex girlfriend. He has no legal right to insert himself into her life.

I love how LSU is going to make the victim into a terrible person. Well done LSU PR team!!

Based on past police reports and now court records, I don't think he needs LSU's help. Where are you coming from with this?

The defendant isn't even allowed to be there. However, there still has to be enough evidence for a judge to issue a temp. restraining order.

Not that I'm disputing anything Liz said, but I find it interesting how Lowery's statements, Long's statements, 3rd party witnesses on the scene, as well as apparently the victims at the hospital are all disputed immediately and called into question. Yet this girl (who refused to comment) applies for an order of protection and everything she said is fact. Maybe I should try your tactics. Liz is a "victim" right? How do we know her friend didn't hit Lowery first? How do we know his "yelling" wasn't just an argument? How do we know she is even telling the truth? We have only heard the side of the "victim". Give me a fricking break.

maybe because lowery's statement was an unknown guy was trying to leave a parking lot, honked his horn, and the football players pulled him out, started beating him, then lowery jumped in to help him out.

maybe this is seen as evidence it may have happened differently than lowery stated. even if a guy hit him first in the bar, that is different than he originally stated.

Well a least this story is backed by a restraining order. Apparently the legal system seems to believe her as well.

She filed a petition for protection. It didn't state she received a protective order. Also, I doubt the same burden of proof exists for a protective order. Anyway, I was just pointing out the ignorant mentality used on here. I believe what she said. I just don't buy that it was related to him pulling a guy from a gang fight.

Well, since looking at facts and forming an educated opinion now qualifies as trolling I guess not.

His ex-girlfriend filed papers attesting to what an a-hole he is and was granted a temp restraining order.

It's a TRO until the hearing. Happens pretty routinely in domestic cases. It's not proof of stalking or doing anything to her. They are generally granted when someone claims the possibility of bodily harm. The restraining order might be granted or dismissed at the hearing. Until the hearing, he's got to stay away from her.

Doesn't make or break the case of the football players at this point.

I still don't see the connection....

....'cause there isn't one.

As much as we all think they may/may not deserve it, you still can't legally fracture someone's vertebrae because you think they're an a-hole.

So, an event that precipitated the fight has nothing to do with said fight?

You are technically correct in that the two are seperate events, but if indeed Lowery started this whole mess the perception of this whole ordeal changes somewhat IMO.

Should he have been kicked? No. But if he knocked over the first domino or two that led to himself being kicked, then it definitely will change the public's perception of him and the player's involvement.
