Judge Axon does not have to issue an order enjoining LSU from pursuing legal action. She merely has to say that the 19th JDC PI does not enjoin the SEC from expelling LSU.

LSU cannot add the two players now. Thus, the 19th JDC PI is arguably moot as to the SEC vis a vis LSU anyway. The players have a cause of action against the SEC, but the 19th JDC PI has no impact on the SEC's actions against LSU.

It's SUCH a goofy argument all the way round.

Except for Vanderbilt, all the SEC members are state bodies. It's been awhile, but I don't think governmental organizations HAVE 1st Amendment Rights of any kind.

Maybe I'm missing it, but what is the justiciable controversy to be decided by Judge Axon?

On a 2/3rds majority vote, the SEC can expel a member for any reason. That's true before, during, and after the 19th JDC proceedings.

The state court enjoined the SEC from punishing a school as a result of this controversy.

So, no, the SEC currently cannot kick LSU out (or punish LSU).

I thought it was to set precedent on self governance and to prevent LSU from running to state court to restrain the SECs ability to vote us out if necessary.

In theory yes. But they want to kitty bar the doors to the courthouse before hand to make sure lsu cant sue them nd fight it

If the SEC was seeking to expel LSU from the SEC for LSU's actions unrelated to the two players, there would be no concern about violating the 19th JDC PI.

However, the SEC is justifiably concerned that the SEC will violate the 19th JDC PI if it expels LSU because of LSU's action concerning the two players.

This is why I’m upset this may settle before the SEC gets slapped down.

Their legal claims are bullshite and their attorneys should be embarrassed for filing them.
