NOT a surprise - Couvillion suing former St Tammany Sheriff and everyone else

Suing the former Sheriff, his buddy that egged him on and… the guy who is acting as interim Sheriff, wasn’t there and had nothing to do with the incident. WTH?

Well, federal courts have jurisdiction over federal civil rights violation claims. Also, larger geographic area for a potential jury, possibly a more impartial and lifetime appointed judge.

The Sheriff was clearly not acting as the Sheriff or a LEO in this instance. Is this guy going to try and link this back to the Sheriff's Office so he can go after the taxpayers pocketbook? Seems like they are going to have a hell of a time trying to argue this is an official act.

Smith was in his Parish provided uniform on the day of the attack and being paid for his time by the Sheriff's Office. Despite how it looks, he was on the clock during the time he attacked Bobby.
Anyone in their right mind would sue the ever living shite out of each party associated with this idiotic act of violence on that day. If it were me attacked, I do not think 1 million tax free dollars would suffice.

this ain’t deadwood, you don’t get to put your gun and badge down on the table and relieve yourself of liability. Had he resigned earlier in the day then yes he’d only be personally liable but as we know, he was still sheriff when he assaulted Mr Couvillion

Randy wasnt in uniform. That guy was hardly ever in uniform. Regardless though… if a deputy, on duty and in uniform, stops by his house to beat the crap out of his wife you are saying that’s part of his duties?

I am not following here. There is job-related conduct that attaches to the employer. But actions clearly outside the scope of employment still bear on the employer in your mind? I don’t think that works.
The Qualified Immunity (that so many people hate) doesn’t apply once the officer is outside the scope and lawful conduct of their employment. I don’t think Randy will get QI and I don’t think the Sheriff’s Office should be held liable for his unreasonable and illegal behavior.

Never said he wasn’t liable. The exact opposite actually. He is 100% liable for his actions. The taxpayers aren’t.

If Trump is at a bar, or football game, you think hes not the president?
He does get to turn off being a sheriff. He also can arrest someone, even if hes in church praying. You dont turn off your elected position

You are clearly defending Smith here and have a opinion that you won't be moved on.
Me I have no dog in this hunt. It has been stated in the past that these 2 had a beef with each other. I don't really care one way or the other. But hear me out here.
I could see the argument that he wasn't on duty or acting in his role as a officer if this just a regular road deputy and out that night with his family and not on the clock and on duty.
But the way I have always understood it if you are sheriff you are always on duty and on the clock, this could further be argued because he salaried and not hourly. Is this a fair argument?
