Never will get a conviction if it ever goes to court. You people forget how stupid people are. I was on a murder trial where the defendant admitted to the shooting but his plea was self defense of another. There was one stupid woman on the jury that didn't even think he was the shooter!!!!

Contradictory testimony in this case will raise a question. Then throw in that the supposed victim is stalking his girlfriend, gets thrown out of the bar twice, now has a restraining order against him, broke into here home and wouldn't leave, has a record and started the fight. Yeah I think simple battery is the absolute worst that JJ will get.

they said it was because he lost consciousness in the warrant; would they have to prove that?

How blind are all you . He is a Sr. he broke curfew. He kicked a guy in the head. He should of waled away. HE IS ANOTHER MIKE VICK IN TRAINING.

I hear you, and agree totally.
However, there is pretty strong indication Lowery was NOT unconscious when you're presuming he was. He personally described details as to who did what at points in which he supposedly was out.

I wish I could find the clip from the movie "Mystery, Alaska" where the jury not only acquits the town grocer (who's also their star hockey forward) of shooting a rep from a big box chain in the foot, but also very proudly awards the grocer $42,000 in damages from the big box chain...something, of course, which was not within their purview to do.

Miles didn't have much choice on this matter...this is something he had to do...not that he wanted to do...

They will offer a please to a lessor charge because the DA wont be able to get a jury to convict. JJ will be back before season is over.

Yes, the state must prove every element of a crime beyond a reasonable doubt. For second-degree battery, serious injuries are one of the elements of the offense.

It appears that the state merely has Lowery's testimony on him going unconscious. The jury can accept or reject that testimony as being credible.

Press just released new evidence. Lowery walks in his sleep. Confirmed. That explains how he is holding himself up on all fours and then gets up moments later and staggers off. He was walking while asleep. JJ is screwed.

You're right. I shouldn't make the assumption that he was out. However, its essentially moot, as it has been said that he was no longer fighting and was lying there not defending himself. If a guy is on the ground, I would never kick him in the head. In fact, that would never even enter the minds of most people I know. Its dishonorable, thuggish, just inherently wrong, and says alot about anyone who would even consider it, much less go through with it, especially over nothing more than a stupid bar fight.

Sure ... there were other LSU players there weren't there? Seems like they'd have talked (yeah I know snitches) if Miles asked them straight up.

Which leads me to the point that if there were other LSU players THERE and saw what happened and just watched, well then that makes my stomach turn even more.

I don't recall Fields being prosecuted for that, BBTAIM, you prove my point, Fields would not be convicted in Louisiana because of ignorance and prejudice not a lack of evidence. A jury pool would probably not convict in spite of any evidence presented.

JJ won't plead to a lesser charge. That was settled yesterday when JJ hired his new attorney. There is no way in hell Lewis is going to let his client plead to a lesser charge. I am telling you Unglesby will fight thing till the bitter end.

Seriously doubt it. Hillar would have to drop charges for both JJ's to get back on the field.

Not irrelevant. JJ has been a model citizen. The Marine has been far from it. THAT DOES MATTER....especially when there are such contradicting stories. I wanted J Lee to play, I think he gives LSU the best chance to win a championship....but JJ is getting the screws on this one so that the BRPD can make it appear they are all over this one.....it's ridiculous.
