I honestly doubt LSU settles.
I'll take that bet. Anyone thinking this was as simple as Kelly saying "if you don't practice you can't play" is naive.
Yeah, they're including everyone in the lawsuit because it helps them in negotiating the settlement but this is a target on a culture and it's a culture LSU will want to protect.
They'll settle.
Alot could have been done on both sides here but ultimately, the Brooks family is saying Greg's health & safety was less of a priority than playing football to LSU, Kelly, House and Cooks and LSU doesn't want testimonies from other players getting out there.

prior to NIL I'd say they'd settle strictly for PR in potential recruiting, but that doesn't matter anymore to future employees, it's just show me the money right now

Oh, I think it still matters ALOT
It's going to be really hard, even with a huge check, to go sit in the living room of a 4 or 5 start recruit and convince him and his family to look beyond a culture that diminishes (or refuses to acknowledge) the possible severity of injuries so a player will continue to practice, play and remain eligible.
I don't think LSU wants to see how many other affidavits or even main stream media stories from unnamed sources that corroborate similar occurrences with this staff.
I think the portal is a bigger factor than NIL. Prior to the portal, you'd have less kids with nothing to lose by sharing their experiences. Now, there's alot of skeletons in that closet and it's in LSUs best interest to keep them there.

(4) LSU/Kelly's breach of duty resulted in Brooks' injuries (No way will they be able to prove this. LSU/Kelly didn't cause the tumor, and Brooks' injury arose in the middle of a complicated brain surgery).
This is where the Brooks lawsuit is completely screwed. If this actually proceeds to litigation, it would be difficult to survive summary judgment. Brooks won't even get the opportunity to play the sympathy card in front of a jury. All the stuff about the "culture" at LSU and Kelly not calling Brooks is just fluff added to the lawsuit to try to trigger a PR settlement. Their case as it pertains to Kelly/LSU really has no merit whatsoever.

I can't imagine the mentions and google hits his name is getting right now. I think he just had to say something. Not get deep, but say something.

You think that statement wasn't vetted by legal?

It is factually incorrect to state that I was not there by Greg's side through this ordeal. I was there on multiple occasions. We had somebody from my staff that was there virtually every single day. We love Greg.

He did not address any allegations of negligence. He stuck to the facts of his presence with Brooks Jr. That's why he was allowed to speak and I'm glad he did.

That and he might have grounds for a defamation suit.

I don't know if its been brought up or not, but I'm guessing the family is also being forced to sue because I know damn well insurance is not just gonna pay everything out if there is even a hint of negligence.

Brooks case won’t even make it to court. Summary judgment will take care of it.

quote:more than likely most of it. I said as much a few pages ago. This will either not survive summary judgment or LSU will settle. I think both sides know that. And I think reaching a settlement is exactly why Brooks' dad wheeled his son onto Good Morning America. They're taking it to the court of public opinion to try to force a PR settlement.
Summary judgment will take care of it.
