This post is insane. Why? If someone owed you $24 million would you just say “aw shucks, I guess that’s it then”? Never mind.

It’s what many of us thought two Sundays ago. It appears he wasn’t fired for cause. That’s the only out the university had.

There were a lot of people posting that there was a done deal and that LSU was “citing morals clause”. Those people were wrong.

That’s the whole ballgame. I am not sure his lawyers are right about the entire lump sum being due as liquidated damages. I actually don’t think they are but I haven’t read the whole contract closely.

Where are you getting this from? They’re just saying that he’s owed the full amount pursuant to the terms of the contract.

I seriously doubt that, unless there is something out there other than the affair thing. I cant imagine Kelly leaving anything on the table over an affair/allegations of an affair that is already common knowledge. I would imagine that would then open LSU in cross examination to having to explain why Miles was paid his full buyout while the university had knowledge of for the staff worker shite.

I also assume LSU would have the burden to prove the affair and more importantly prove that the affair caused some level of harm to the university's reputation. In this day and age, I cant imagine they would be able to do that. Not to mention, every potential hire from that point forward would be wary of coming here over the possibility of losing generational wealth over something as professionally irrelevant as extramarital conduct.

What is incredible to me is that if nothing in the contract addresses performance, then LSU and other schools creating contracts like this provide no recourse.

Head Coaches have all the leverage, absent moral clauses or breaking local, state, and federal laws. Without performance checks, the HC can do a great job or a terrible job; either way, the HC gets paid. What a financial boon for the HC. No wonder ADs are not Hedge Fund managers. Ha

Kelly wanted to fire Sloan and Davis. LSU administration refused to allow Davis to be fired.

The governor has enormous amount of influence on academics and athletics.

Administration would not allow Kelly to do his job.

So, it's the Administration's fault that Kelly's teams executed so poorly?

Plus, if the Administration controlled Kelly's football operations, then instead of complaining, he could comply and watch his LSU team fall apart. For 54 million, Kelly becomes totally mercenary.

Interesting hedge fund analogy.

By your logic, If you give your hedge fund manager a few million and he does everything above board but in good faith he makes some investment choices, that thru any one of numerous factors affecting the market, it turns into a few hundred thousand, you should be able to get that all or a portion of that money back from him.

Good luck with that.

And for the record, I think its obscene that football coach's AND hedge fund managers bank what they do. But it takes a minimum of two parties to execute a contract of services.

This is well-deserved for a POS administration at LSU. I hope they get teamed by his lawyers. Not for his benefit, but just to punish their shear incompetence and arrogance.

This program and system is such garbage right now that it is unbelievable.

One could argue legally that 3.5m is fair market value for a coach just fired for failure to perform at a university with an abundance of resources.
