Based on visual video evidence.... where do you think Karen passed to get past the accident if this truck didn't swerve off the road? His proper lane now has a head on collision blocking it. So where else could Kyren have passed the accident if not for the oncoming traffic lane?

He's never made any claim suggesting misconduct by the DA. Just the opposite, actually. There's nothing to walk back.

The DA report does not confirm the police conclusion. The DA report says there's no reason Lacy should have known he caused this accident.

The presumption in a rear-ender accident is that the striking vehicle is at fault. But that presumption can be rebutted such as for example if a lunatic in a dodge charger is driving 50 miles over the speed limit into oncoming traffic in front of the vehicle that is struck. This is well understood in the law and is called the sudden emergency doctrine. You will get my bill for .4 hours in the mail for this poast.

"presumably going 40"...You have no idea how fast those cars were going... same evidence as saying presumably they were all driving well below the speed limit for him to pass 4 cars at one time.

Why DIDN'T the lawyer provide the speed of the green charger as it returned to the southbound lane after illegally passing 4 cars in a no passing zone? Or the danger KL imposed onto others forcing them to react in less than 1.5 seconds to avoid a crash.

Driver 2 has fault for following too closely and swerving into oncoming traffic.

KL has fault for carless driving leading to the accident.

Very sad situation for all involved. Three families damaged, two lives lost.
