Well, for one it definitely compromises the chain of custody of the audio. There's no way to safeguard that what HBO got wasn't altered, or manipulated.

The Original tapes have not been released by the FBI. The person on trial is entitled to all the government evidence against him. Copies and were given to the defendant Dawkins. Dawkins can release them if he wishes. They keep talking FBI tapes, but these are not the FBI tapes. They are only copies. Copies can be altered.

As Woodward said this is nothing new. The situation is the same.

That’s the big point here. The tape copies are not real evidence unless they can find the money to corroborate them. I am pretty sure the NCAA has looked high and low for the money supposedly given Smart and has not found anything. Until they find corroborating evidence no matter how many times they run those copies of the tapes on national TV television the NCAA is not likely to do anything.

This is a campaign by a news service to get LSU punished. The NCAA is treading carefully,

It was absolutely put under a protective order and the Judge warned against any more leaks during the trial.

And as it was not used in court, the wiretap evidence was absolutely sealed by the FBI. You’d have to be able to prove who leaked it during the trial and even now to be able to do anything about it though, even if it is obvious

It would be highly unusual for the FBI to hand over sealed wiretaps or other evidence that went unused at trial to NCAA compliance officials even after the criminal cases conclude.

Yahoo claimed there was several thousands of hours of wire tapes collected by the FBI during this time. If Wade and LSU are going to be punished due to what came out during the trials, then the NCAA should also do whatever it takes to get their hands on every single piece of evidence the FBI has on the other coaches.

Since other defendants took plea deals and we didn't get trials revealing all the dirty details on other cases and coaches (Like Chuck Person, Bruce Pearl), this seems like a fair way of handling matters. Let's get everything out in the open.

Money talks?

That's funny. Wasn't that what the wiretap tapes were taping.....coaches talking about money for play?

That shite was ridiculous. If any program would get in trouble for that crap, that’s f’d up. I don’t know the law very well, but how that wasn’t entrapment...I don’t know.

The Dawkins guy clearly didn’t want to pay any coaches and was stating how dumb it was to do that and actually disobeying the FBI by not doing it.

No that’s not what the investigation was about. It was a wire fraud case then a bribery case involving Dawkins and his cohorts, Adidas and a makeshift agency.
